What is a 362 motion?
Under Bankruptcy Code section 362(a), the "automatic stay" applies at the moment a bankruptcy petition is filed.
This offers protection from creditors who must file a "Relief from Stay" motion to ask the judge to terminate the stay to take action against the debtor or debtor's property outside of the bankruptcy court.- A motion to lift stay is a suit filed by a creditor in a bankruptcy case against a debtor.
The lawsuit aims at helping a creditor to repossess the collateral.
If well-executed, it enables a creditor to get back a car, or any collateral surrendered in a bankruptcy case.
