In the United States, a different principle is established

Our constitution declares a treaty to be the law of the land

It is, consequently, to be regarded in courts of justice as equivalent to an act of the legislature, whenever it operates of itself, without the aid of any legislative provision

As a result of the supremacy clause, the Constitution is such a higher law; it is the "supreme law of the land

" In the exercise of judicial review, the supreme court claims the office of ultimate interpreter of the Constitution

It has thus become commonplace to think of decisions of the Court as the law of the land
