Rawls constructivism

  • Is Rawls a constructivist?

According to Weber, Rawls is simultaneously committed to constructivism as well as to a Kantian philosophy of (noumenal) freedom.
Dewey rejects the noumenal self since only real people can be held responsible.
In his anti-Kantian view, freedom is not a prerequisite to moral action but rather acquired through education.Jul 14, 2011.

  • What kind of theory does Rawls have?

John Rawls developed a theory of justice.
His theory suggests that the principles of justice should be determined by individuals in a hypothetic initial position.
In the initial position, individuals agree on principles of justice..

  • A viable constructivist theory of justice presupposes that the deliberative capacity of reasonable persons functions as a reliable engine of progress. 95.

Rawls explains the core idea of constructivism as follows: it is 'to establish a suitable connection between a particular conception of the person and the first principles of justice, by means of a procedure of construction' (Rawls 1980: 516).
Rawlsian constructivism gives guidelines for how existing conflicts between normative judgments can be handled and a more reflective—albeit provisional—moral position can be achieved. The second point to emphasise is how the use of moral principles provides a critical standard.

Is Rawls a'minimalist' law theory?

Rawls’s approach may be said to possess the elements of a “minimalist” natural law theory, of legal conventionalism, and of the artifactual legal theory, and may even be said to endorse a form of the positivistic claim for the essential separation between the concept of law and substantive moral values

Is Rawls's constructivism more practical?

We have, however, argued that a more practically oriented version of it can be found in Rawls’s wider methodology

The core idea of Rawlsian constructivism is to utilise the process of reflective equilibrium to advance shared solutions to practical problems agents face in social life

The practical value is central
