Copyright law between countries

  • What is European copyright law?

Copyright refers to a range of rights granted to authors and performers, producers and broadcasters, principally: Economic rights allowing rights-holders to control how their work and other protected material is used, and to receive payment for it..

  • In most cases, protection of your copyright work abroad will be automatic in the same way UK protection works.
Copyright law internationally is not statutorily bound but is instead based on treaties. Therefore, no work will be protected by statute in every country of the world. However, several key international treaties attempt to ensure uniformity amongst member states.
Each country has its own unique copyright laws that govern intellectual property (like copyright) in that country. A country's copyright laws only apply to works created and used in that country. This means that the copyright an author holds in the United States may not be valid in other countries.

Can the US Copyright Office recommend a lawyer?

The U.S.
Copyright Office is not permitted to recommend attorneys or agents to give legal advice on foreign or domestic laws.

How does copyright protection work in Europe?

European countries follow the principle that copyright protection is granted automatically upon creation of the work.
This principle was first established in the Berne Convention (1886), and Article 5 of the Convention expressly forbids any member country to require formal action for copyright protection.

,

Is there an international copyright?

There is no such thing as an “international copyright” that will automatically protect an author’s writings throughout the world.
Protection against unauthorized use in a particular country depends on the national laws of that country.

,

Why are international copyright conventions and treaties important?

International copyright conventions and treaties have been developed to establish obligations for treaty member countries to adhere to, and implement in their national laws, thus providing more certainty and understanding about the levels of copyright protection in particular countries.
