Under Korean law, a copyrightable work is defined as “a creative production that expresses human thoughts and emotions.” In other words, in order to be protected by copyright law in Korea, a work must satisfy three different requirements.
First, a work needs to be “creative,” meaning the work is original and not an imitation of someone else’s work.

Under Article 2(1) of the Copyright Act, the term “copyrighted works” is defined as “creative works of authorship which express human thoughts and emotions”.
In other words, to qualify for copyright protection, a work is required to have creativity and express human thoughts and emotions.

Article 133bis of the Korean Copyright Act allows the Korean Copyright Commission to request that the ISPs suspend the accounts of repeat file-sharing offenders, as determined by the Commission, for six months, and to upgrade this request to a demand if the Ministry becomes involved; the ISP has to follow the Ministry-backed demand or face a fine.

1.2 Conventions and Treaties South Korea became a party to the Berne Convention for the Protection of Literary and Artistic Works (Paris Text 1971) in 1996, joined the World Intellectual Property Organization (WIPO) Copyright Treaty in 2004 and the WIPO Performance and Phonograms Treaty in 2008.
