Under the terms of a DPA, the government files criminal charges against a company, but holds prosecution of the charges in abeyance until the company satisfies the terms of the DPA.
Unlike with DPAs, no charges are filed against companies that enter NPAs so long as they comply with specified sanctions.
A Deferred Prosecution Agreement is a contract that you enter into with the State Attorney's Office.
It is a diversion program that keeps your case from moving forward before the judge.
DPAs are intended to sanction criminal conduct appropriately and deter wrongdoing.
They retain aspects of a negotiated plea agreement, including an admission of facts and imposition of a financial penalty.
Under a DPA, the agency files a charging document with the court, but simultaneously requests that the prosecution be postponed to allow the defendant to demonstrate its good conduct.
In exchange, DPAs generally require the defendant to agree to: Pay a fine.
Waive the statute of limitations.
