What is the European Court of Justice for Human Rights?
The ECtHR was set up in 1959, it is based in Strasbourg. 2.
It hears applications alleging that a contracting state has breached one or more of the human rights provisions concerning civil and political rights set out in the European Convention on Human Rights (ECHR) and its protocols.You have the right to respect for your private and family life, your home and correspondence.
You have the right to freedom of thought, conscience and religion.
You have the right to practise your religion at home and in public and to change your religion if you want.
Can we still use European Court of Human Rights?
You can't bring a case against an individual or a private organisation for breaching the rights in the ECHR.
However, if the government or public body breaches your human rights, you can take them to court in the UK, because the Human Rights Act brings these rights into UK law.
Who can apply to the European Court of Human Rights?
The applicant must be, personally and directly, a victim of a violation of the Convention, and must have suffered a significant disadvantage.
