What is the procedure provided in this code in regard to suits?
The procedure provided in this Code in regard to suits shall be followed, as far as it can be made applicable, in all proceedings in any Court of civil jurisdiction.[Explanation .-In this section, the expression "proceedings" includes proceedings under Order IX, but does not include any proceeding under article 226 of the Constitution.]
Who is a decree holder under Civil Procedure Code?
Under Section 2 (3) of the Civil Procedure Code, any person in whose favour a decree or an order capable of execution has been passed, he/she is referred to as the Decree Holder. Accordingly, any decree passed in favour of a person who is not even a party to the suit shall also be considered as the Decree holder under the code. What is a Judgment?
When does the Code of civil procedure come into force?
Short title, commencement and extent .- This Act may be cited as The Code of Civil Procedure, 1908. It shall come into force on the first day of January, 1909.
