Quel est la réglementation concernant une caméra de surveillance ?
Le décret du 27 novembre 2023 prévoit que les caméras composant le dispositif de vidéoprotection doivent être déconnectées des caméras installées à l'intérieur du lieu ouvert au public pour que le responsable ou ses subordonnés ne puissent avoir accès aux images enregistrées les caméras extérieures (article R. 251-1).
Qui a le droit de visionner les vidéo surveillance ?
Qui peut consulter les images ? Seules les personnes habilitées par l'autorisation préfec- torale, et dans le cadre de leurs fonctions (par exemple : les agents du centre de supervision urbain d'une commune), peuvent visionner les images enregistrées.
Rien ne lui interdit de le faire.
Il peut en mettre à l'intérieur de son domicile ou à l'extérieur, à partir du moment où seule sa propriété est filmée.
Les caméras installées ne peuvent filmer que sa propriété : l'intérieur du logement, le jardin, le chemin d'accès privé , ou encore la façade du domicile.
