Who grants patents in Europe?
Currently, (technical) inventions can be protected in Europe either by national patents, granted by the competent national IP authorities in EU countries or by European patents granted centrally by the European Patent Office .
The decision of the Examining Division to grant a European patent takes effect on the date on which the mention of the grant is published in the European Patent Bulletin.
The Examining Division is then bound by its final decision on an application, which can be set aside only following an admissible, allowable appeal.
What countries are in the EPC?
There are, as of October 2022, 39 Contracting States to the EPC, also called member states of the European Patent Organisation: Albania, Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania,
How does the European Patent Convention work?
In each contracting state for which it is granted, a European patent gives its proprietor the same rights as would be conferred by a national patent granted in that state.
If its subject-matter is a process, protection is extended to products directly obtained by that process.
