copyright in databases
What are the rights of database ownership?
Database rights last for 15 years.
Each time a database is substantially modified, however, a new set of rights are created for that database.
An owner has the right to object to the copying of substantial parts of their database, even if data is extracted and reconstructed piecemeal. Is there copyright in data?
Data are considered discoverable "Facts," not original works in themselves, and are thus not copyrightable.
The methods of compilation, analysis, annotation arrangement, or selection of data, which may be novel, unique, or proprietary, can be protected under copyright.Similarly, an ordinary database is not by itself patentable because there is nothing new or novel about a database.
However, if software provides a relational database with a new way to manipulate the data in a manner that is useful to users, that new idea may be patentable.
What are the intellectual property rights in databases?
Intellectual property rights (IPR) management is an important part of any data management plan.
A builder of a database or other data resource will have an interest in who owns that resource and how others may use it.
