  • How do you use the Fourth Amendment?

    The Fourth Amendment prohibits the United States government from conducting “unreasonable searches and seizures." In general, this means police cannot search a person or their property without a warrant or probable cause. It also applies to arrests and the collection of evidence.
  • What is the 5th Amendment?

    A right against forced self-incrimination. A guarantee that all criminal defendants have a fair trial, and. A guarantee that the government cannot seize private property without making a due compensation at the market value of the property.
  • What does it mean to be secure in their persons?

    According to the Fourth Amendment, the people have a right “to be secure in their persons, houses, papers and effects, against unreasonable searches and seizures.” This right limits the power of the police to seize and search people, their property, and their homes.
  • It came into existence with the 1914 decision in Weeks v. United States and became completely applicable to the States in the 1961 case of Mapp v. Ohio. Most of the limits on the rule were created or expanded by the Burger Supreme Court of the 1970's and 1980's.
