How successful is the ECHR?
Five decades later, it is undisputed that the ECHR has been successful in carrying out its mission, judging from its influence on the laws and social realities of the contracting parties, the extensive jurisprudence in the field of the protection of human rights, as well as the remarkable compliance with the ECtHR's judgments.
How does the ECtHR interpret the convention?
The court's primary means of judicial interpretation is the living instrument doctrine, meaning that the Convention is interpreted in light of present-day conditions. International law scholars consider the ECtHR to be the most effective international human rights court in the world.
Does the European Court of human rights have jurisdiction?
The jurisdiction of the court has been recognized to date by all 46 member states of the Council of Europe. On 1 November 1998, the court became a full-time institution and the European Commission of Human Rights, which used to decide on admissibility of applications, was abolished by Protocol 11.
When does ECHR come into force?
This edition entered into force on 22 January 2024. Any additional texts and updates will be made public on the Court’s website (www.echr.coe.int). 1. As amended by the Court on 7 July 2003, 13 November 2006 and 19 September 2016.
