Notice of proposed rulemaking. This rule proposes to amend the U.S. Customs and Border Protection (CBP) regulations to require customs brokers to collect certain information from importers to enable the customs brokers to verify the identity of importers, including nonresident importers.
Who is an importer of record?
“Importer of Record” is defined as the owner or purchaser of the goods, or when designated by the owner, purchaser, or consignee, a licensed Customs broker. 5.1.3 A nominal consignee may designate a Customs broker to make entry on his behalf but may not make entry on his own behalf.
Does CBP accept electronic signatures on form 5106?
CBP will accept electronic signatures on the form. To comply with the recordkeeping requirements outlined in 19 CFR 163, a soft copy of the signed CBP Form 5106 should be retained by the Customs Broker and be available to be provided to CBP upon request.
