Dear Friends,

I hope you and your family are keeping safe and

doing well. After the unexpected interruption in the construction activities due to Covid-19 pandemic, the activities are slowly resuming now. During the crisis, ACCE (I) and our members have contributed towards the relief activities and supported the

Government departments. Many of our ACCE (I)

canters have organized knowledge dissemination activities through the webinars. I thank all our members for their timely response and magnanimitytowardsthesociety.

While we are worrying about Covid-19, suddenly

there is a lot of discussion among Architects & Engineers on their roles and responsibilities; who hastodowhat?

Engineers are demanding for

from long time, a bill for engineers to register and to follow ethics code. As reported by The Hindu dated

15th September 2019, First draft of Bill has been

submitted to HRD Ministry. The bill is taking its finalshapeundertheaegisoftheAllIndiaCouncilof

Technical Education

(AICTE) and the

Ministry of Human

Resource

Development. The

first draft of the Bill has been submitted to the Ministry. It has been suggested to have a council to register engineers on the lines of those that exist for lawyers, doctors, architects and pharmacists. The Bill has been draftedby a committeeconstituted by the AICTE.The committee comprises Sandeep Sancheti, Vice-

Chancellor of SRM Institute of Technology,

Chennai; M.S. Ananth, former director of the Indian

Institute of Technology -Madras; and J.

Chandrasekhar, chairperson of Aerospace, School of

Engineering, AmritaVishwa Vidyapeetham,

Coimbatore. Mr. Ananth is the chairman of the

committee.

AICTE chairman Anil D. Sahasrabuddhe told The

Hindu that the committee had handed over its

recommendations and it is in the discussion stage.

He has also said that some more changes are

requiredanditwilltakesometime.

ACCE(I) is meticulously following

through the past

PresidentEr.SannaRatnavel,andworkingtowards

its successful passage through the Indian parliament.

Even though the roles and responsibilities have

been very clearly stated in the Architects Act-1972 and the National Building Codes (NBC), some friends of Architecture through Council of

Architecture (COA) keep on trying to misrepresent

the Architects Act by redefining Architectural

Servicesagainandagain.

A-1ESSENTIALREQUIREMENTS

A-2.1Architect

A-2.1.1Competence

A-2.2EngineerEvery building/development work for which permission is sought under the Code shall be planned, designed and supervised by registered professionals. The registered professionals for carrying out the various activities shall be: (a) Architect, (b) Engineer, (c) Structural engineer, (d)

Geotechnical engineer, (e) Supervisor, (f) Town

planner, (g) Landscape architect, (h) Urban designer, and (j) Utility service engineer.

Requirements of registration for various

professionals by the Authority or by the body governing such profession and constituted under a statute, as applicable to practice within the local body's jurisdiction, are given in A-2.1 to A-2.8. The competenceofsuchregisteredpersonneltocarryout various activities is also indicated in A-2.1.1 to A-

2.8.1. The qualification and competence of the

engineers for utility services and of builder/constructor shall be as prescribed in A-2.9 andA-2.10,respectively.

The minimum qualifications for an architect shall

be the qualifications as provided for in the

Architects Act, 1972 for registration with the

CouncilofArchitecture.

Theregisteredarchitectshallbecompetenttocarry

out the work related to the building/development permitasgivenbelow: a) Preparation of all plans and information connected with building permit except engineering services of high rise/ special buildingsgivenin12.2.5.1 b) Issuingcertificateofsupervisionandcompletion of all buildings pertaining to architectural aspects. c) Preparation of subdivision/ layout plans and related information connected with development permit of area up to 1 hectare for metro-cities,and2hectareforotherplaces. d) Issuing certificate of supervision for development of land of area up to 1 hectare for metro-cities,and2hectareforotherplaces.

Theminimumqualificationsforanengineershallbe

graduate in civil engineering/architectural engineering of recognized Indian or foreign university, or the Corporate Member of Civil Engineering Division/ Architectural EngineeringDivision of the Institution of Engineers (India) or the Member of the statutory body governing such profession,asandwhenestablished. The registered engineer shall be competent to carry out the work related to the building/development permitasgivenbelow: a) Preparation of all plans and information connectedwithbuildingpermit. b) Structural details and calculations of buildings including subsurface investigation on plot up to

500m andupto5storeysor16minheight.

c) Issuingcertificateofsupervisionandcompletion forallbuildings. d) Preparation of subdivision / layout plans and related information connected with development permit of area up to 1 hectare for metro-cities,and2hectareforotherplaces. e) Preparation of all service plans and related information connected with development permit. f) Issuing certificate of supervision for developmentoflandforallarea.

The minimum qualifications for a structural

engineer shall be graduate in civil engineering of recognized Indian or foreign university, or

Institution of Engineers (India), and with minimum

3 years' experience in structural engineering

practicewithdesigningandfieldwork NOTE: The 3 years' experience shall be relaxed to 2 years in the case of post graduate degree of recognized Indian or foreign university in the branch of structural engineering. A-2.5.1CompetenceThe registered structural engineer shall be competent to prepare the structural design, calculations and details for all buildings and carry outsupervision.

A-2.3.1.1 In case of buildings having special

structural features, as decided by the Authority, which are within the horizontal areas and vertical limits specified in A-2.2.1(b) and A-2.5.1(a) shall be designedonlybystructuralengineers.

The minimum qualifications for a geotechnical

engineer shall be graduate in civil engineering ofrecognized Indian or foreign university, or

Corporate Member of Civil Engineering Division of

Institution of Engineers (India), and with minimum

3 years' experience in geotechnical engineering

practicewithdesigningandfieldwork.

The 3 years' experience shall be relaxed to 2

years in the case of post graduate degree of recognized Indian or foreign university in the branch of geotechnical engineering. In case of doctorate in geotechnical engineering, the experiencerequiredwouldbeoneyear.

The registered geotechnical engineershall be

competent to carry out subsurface investigations andgivereportthereof.Thesemayinter-aliainclude performing various tests required to determine engineering properties of sub-strata and ground water and making recommendations about the type of foundation, soil bearing capacity and the depth at which the foundations shall be placed, considering the structural system and loads supplied by the engineer/structuralengineer.

The minimum qualifications for a supervisor shall

be diploma in civil engineering or architectural assistantship, or the qualification in architecture or engineering equivalent to the minimum qualification prescribed for recruitment to non- gazetted service by the Government of India plus 5 years' experience in building design, construction andsupervision.

The registered supervisor shall be competent to

carry out the work related to the building permit as givenbelow: a) Allplansandrelatedinformationconnectedwith building permit for residential buildings on plot up to 200 m2 and up to two storeys or 7.5 m in height;and b) Issuing certificate of supervision for buildings as per(a).NOTE:

A-2.6.1Competence

A-2.7LandscapeArchitect

A-2.7.1CompetenceTheminimumqualificationforatownplannershall be the Associate Membership of the Institute of

Town Planners or graduate or post-graduate

degreeintownandcountryplanning.

The registered town planner shall be competent to

carry out the work related to the development permitasgivenbelow: a) Preparationofplansforlandsubdivision/layout and related information connected with developmentpermitforallareas. b) Issuing of certificate of supervision for developmentoflandofallareas.

However, for land layouts for development

permit above 5 hectare in area, landscape architect shall also be associated, and for land development infrastructural services for roads, water supplies, sewerage/drainage, electrification, etc, the registered engineers for utility services shall be associated.

The minimum qualification for a landscape

architect shall be the bachelor, master's degree in landscape architecture or equivalent from recognizedIndianorforeignuniversity.

The registered landscape architect shall be

competent to carry out the work related to landscape design for building/development permit forlandareas5hectareandabove.Incaseofmetro- cities, this limit of land area shall be 2 hectare and above.

For smaller areas below the limits indicated

above, association of landscape architect may also be considered from the point of view of desired landscapedevelopment.NOTE: NOTE

A-2.8UrbanDesigner

A-2.8.1Competence

A-2.9EngineersforUtilityServicesThe minimum qualification for an urban designer shall be the master's degree in urban design or equivalent from recognized Indian or foreign university. The registered urban designer shall be competent to carry out the work related to the building permit for urban design for land areas more than 5 hectare and campus area more than 2 hectare. He/she shall also be competent to carry out the work of urban renewal forallareas.

NOTE For smaller areas below the limits indicated

above, association of urban designer may be considered from the point of view of desired urban design.

For buildings identified in 12.2.5.1, the work of

Inconclusion;

AssociationofConsultingCivilEngineers(I),anationalbodyofCivilEngineerswhichisworking towards betterment of the Civil Engineering profession has taken the lead by forming a task force for fighting the injustice being planned against the community. The association will inform and demand all Government/local authorities to include the engineers/diploma holders as competent persons for undertaking designing, planning etc. as per the competence as defined intheNationalBuildingCodeofIndia2016. ACCE (I) is also writing to all the concerned bodies / departments to suitably amend their Building Bye-Laws/Rules and Advertisements for Planning, Design & Construction related projects.building and plumbing services shall be executed under the planning, design and supervision of competent personnel. The qualification for registered mechanical engineer (including HVAC), electrical engineer and plumbing engineers for carrying out the work of Air conditioning,

Heating and Mechanical Ventilation,

Electrical Installations, Lifts and

Escalators and Water Supply, Drainage,

Sanitation and Gas Supply installations

respectively shall be as given in Part 8

Building Services and Part 9 Plumbing

Services of the Code or as decided by the

Authority taking into account practices of

the national professional bodies dealing with the specialist engineering services. Such an approach shall be followed for association of other/multi- disciplinary professionals for taking inputs and associatingwiththeirareasofspecialization.

The minimum qualification for the

builder/constructor or his representative for executionofrespectiveworksshallbeasgiveninA-

2.1, A-2.2, A-2.3, A-2.4, A-2.5, A-2.6, A-2.7, A-2.8

andA-2.9fortheconcernedprofessional.

A-2.10.1 Competence The qualified

builder/constructor or his representative shall be competent to carry out execution of work, which shall have the same extent as for supervision by such professional as prescribed in A-2.1.1, A-2.2.1, A-2.3.1, A-2.4.1, A-2.5.1, A-2.6.1, A-2.7.1, A-2.8.1 andA-2.9.A-2.10BUILDER/CONSTRUCTOR
