ThisCountryFocusreportonTurkeywrittenattherequestofboththeEuropeanParliament andtheEuropeanCouncilforgeneralbackgroundinformationandmoredetailedinformation relevantforinternationalprotectionstatusdeterminationandfortheassessmentofthe applicabilityofthesafecountryoforiginconcepttoTurkey.Forthe designationofsafe countriesoforigin,AnnexIoftheAsylumProceduresDirectiveforeseesthat: 'Acountryisconsideredasasafecountryoforiginwhere,onthebasisofthelegal situation,theapplicationofthelawwithinademocraticsystemandthegeneral politicalcircumstances,itcanbe shownthatthereisgenerallyandconsistentlyno persecutionasdefinedinArticle9ofDirective2011/95/EU,notortureorinhumanor degradingtreatmentorpunishmentandnothreatbyreasonofindiscriminate violenceinsituationsofinternationalorinternalarmedconflict' ( 2 ). Inaddition,'accountshallbetaken,interalia,oftheextenttowhichprotectionisprovided againstpersecutionormistreatment'( 3 ).TheTurkeyCountryFocusathandcoversthemost importantinformationneedsrelatedtotheaboveͲmentionedcriteriaforsafecountryof origindesignation,namelystatestructure,socioͲpoliticallandscape,ruleoflawandstate protection,securitysituationandhumanrightssituation.TheTermsofReferencecanbe foundattheendofthereport. DefiningtheTermsofReference TheTermsofReferencehavebeendefinedon8April2016takingintoaccountfeedbackfrom theEASOCountryofOriginInformation(COI)StrategicNetwork. Draftingprocess TheinitialcollectinginformationanddraftingofthisreportwasdonebetweenAprilͲJuly2016 byCOIspecialistsfromtheCOIunitsandasylumoffices,andbyEASOstaff.Duringthisprocess,

1.2Executivebranch
Accordingtotheconstitution,theexerciseoftheexecutivepowerisvestedinandisusedby thePresidentandtheCouncilofMinisters( 12 ).
1.2.1ThePresidentoftheRepublic
ThePresidentoftheRepublicistheheadofstateandrepresentstheRepublicofTurkeyand theunityoftheTurkishnation( 13 ).ThePresidentoverseestheworkingsoftheconstitution andguaranteesthattheorgansofthestatefunctionorderlyandharmoniously( 14 ). AccordingtoArticle101oftheTurkishconstitution,thePresidentiselectedbypopularvote fromtheTurkishGrandNationalAssembly(GNATorGNA),'whoareover40yearsofageand havecompletedhighereducation,oramongTurkishcitizenswhofulfiltheserequirements andareeligibletobedeputies' ( 15 ). ThePresidentshallbeelectedforamaximumoftwotermsoffiveyearseach.ThePresident's dutiesandpowersrelatetothelegislative,executiveandjudicialbranches;thePresidentis also'responsibleforensuringtheimplementationoftheConstitution,andtheregularand harmoniousfunctioningoftheorgansof state'( 16 ). FormerlythePresidentwaselectedbytheparliamentbutaftertheconstitutionalamendment of2007(adoptedbyareferendum),whichsetupapopularelection,Turkeyhelddirect presidentialelectionsforthefirsttimeinAugust2014( 17 ).PrimeMinisterRecepTayyip ErdoOEanprevailedwith51.8percentofthevote,winningaonceͲrenewablefiveͲyear term( 18 ).Sincethisfirstdirectpresidentialelection,despiteaparliamentaryconstitution, TurkishpoliticalregimehasbecomedefactoasemiͲpresidentialsysteminwhichthe PresidenttakesthekeydecisionsandthePrimeMinisterputsthemintoeffect,accordingto variousanalysts( 19 ).

TheCouncilofMinisters(Cabinet)consistsofthePrimeMinister,designatedbythePresident oftheRepublicfrommembersoftheTurkishGrandNationalAssembly(GNAT),andvarious ministersnominatedbythePrimeMinisterandappointedbythePresidentoftheRepublic.
