Il sÕ agit raduit par une composition paritaire des organes du Centre de mŽdiation et dÕarbi- trage, lequel est composŽ du Conseil de lÕarbitrage, chargŽ de superviser les procŽdures arbitrales et du Conseil scientifique, chargŽ dÕanimer la rŽflexion sur lÕarbitrage et la mŽdiation franco-arabe sans aucune inte rac- tion avec les procŽdures arbitrales. LÕun et lÕautre sont assistŽs dÕun secrŽ- tariat qui assure le bon fonctionnement de leur mission. La composition strictement paritaire doit permettre ˆ chacun des acteurs de lÕarb itrage arbitrales de prendre en compte les spŽcificitŽs des parties auxquelles elles sont destinŽes, afin dՐtre mieux acceptŽes et donc mieux exŽcutŽes par elles. CÕest dÕailleurs pourquoi les parties choisissent les arbitres quÕ elles souhai-tent et que la liste de noms proposŽs par le Centre ne le sera quÕ

ˆ titre indi-catif. Dans un litige franco-arabe, le Centre veillera simplement ˆ ce que lesdeux cultures soient bien reprŽsentŽes ou respectŽes au sein du

tribunalarbitral. Le choix du recours ˆ lÕarbitrage de la Chambre franco-arabe pourr a notam-ment se faire par une clause compromissoire ainsi libellŽe : Tout diffŽrend dŽcoulant du prŽsent contrat, ou en relation avec celui- Chambre de commerce franco-arabe par un ou plusieurs arbitres nom-

FOREWORDThe Franco-Arab arbitration system is situated at the crossroads of multi-cultural traditions, which have been enriched over centuries of exchangesand collaboration.

From this mix there has arisen a practice which, through its rigour and seri-ousness, and reliance on independent, impartial and competent arbitrators,has won the trust of commercial actors.

The Arbitration Rules of the Franco-Arab Chamber of Commerce areaimed at providing any natural person or legal entity, irrespective ofnationality, with a means of resolving disputes through arbitration that isbased on the dual French-Arab culture of this Chamber of Commerce. It isa question of providing a system that reflects this dual origin, expressed bythe equal composition of the organs of the Mediation and ArbitrationCentre, which is composed of the Arbitration Board, responsible for super-vising the arbitration procedures, and the Scientific Board, in charge ofleading reflection on Franco-Arab arbitration and mediation without anyinteraction with the arbitration proceedings. Each of these is assisted by asecretariat that ensures the proper functioning of their mission. The strict-ly equal composition allows all participants in Franco-Arab arbitrationmatters to have confidence in the proposed system and allows the arbitra-tion decisions to take account of the intricacies of the parties to whom suchdecision are directed, in order that they be better accepted and thereforebetter executed by said parties.

Moreover, this is why the parties choose the arbitrators they wish and thelist of names put forward by the Centre is for information only. In anyFranco-Arab dispute, the Centre will simply ensure that the two cultures areproperly represented and respected in the arbitral tribunal.

Similarly, such regulation keeps as close as possible to the wishes of theparties by proposing, in an innovative way, options so that the parties can,either before or during the proceedings, organize the arbitration that is bestsuited to their dispute.

The option of using Franco-Arab Chamber of Commerce arbitration can, inparticular, be made through an arbitration clause worded as follows:

Any disagreement arising from the present contract, or in relation to it

,will be resolved once and for all in accordance with the Franco-ArabChamber of Commerce Arbitration Rules by one or more arbitratorsappointed in conformity with this Rules.
