Welcome to the Le Château Condominium Association As an Owner of a Le Château C ondominiu m resid ence, you are automatically a member of the Le Château Condominium Association, a non-profit corporation. The mission of the Association is to preserve and enhance Le Château Condominium's short- and long-term financial health, to maintain the quality of life at a standard expected of a high-end Buckhead property, and to honor and protect the aesthetics so important to achieving optimum property values. The primary fu nction of the Associat ion is to administer the p rovisions of the Declaration and Bylaws of Le Château Condominium in a fair, logical, legal, and non-discriminatory manner to the maximum benefit of its members. To this end, the elected Board of Directors oversees the operation s of the Association with the assistance of Heritage Property Management Services, Inc., a professional property management group. The Le Château Condominium Standards of Conduct, Rules and Regulations serve as a guide highlighting many situations and circumstances common to condominium community living. The items outlined in this document describe specific measures, circumstances and their enforcement as they relate to the Declaration and Bylaws of the Le Château Condominium community. We have learned that the quality of your experience as an owner depends largely on your knowledge of what you can expect from the Association, and what the Board of Directors can expect fro m you as a participating memb er of t his wonderf ul community we call home. The rules contained herein supersede and take precedence over any other owners guide available on-line, published and distributed prior to January 31, 2012, and are issued pursuant to the Le Château Declaration of Condominium and Bylaws. 1 LE CHÂTEAU CONDOMINIUM ASSOCIATION STANDARDS OF CONDUCT, RULES AND REGULATIONS This document is not intended to be an exhaustive review of the Declaration and Bylaws. Owners and Occupants are responsible for reading and being familiar with the provisions of the Le Château Declaration and Bylaws. DEFINITIONS The followin g definitions are defined by De claration of Condominium for Le Château Condominium. All Owners and Occupants should become thoroughly familiar with the definition of these terms in the Declaration. Common Elements shall mean those portions of the property subject to the Declaration which are not included within the boundaries of a Unit, including but not limited to: the lobbies, elevators, hallways, dumpsters, and fitness facilities. Limited Common Elements shall mean a portion of the Common Elements reserved for the exclusive use of those entitled to occupy one or more, but less th an all, Unit s - including, but not limited to parking spaces, mailboxes, balconies, and patios. Occupant shall mean any Person staying overnight in a Unit for a total of more than thirty (30) days, either consecutive or nonconsecutive, in any calendar year, regardless of whether such Person is a Occupant or the Owner of such Unit. Owner shall mean the record title holder of a Unit within the Condominium, but shall not include a Person who is only a Mortgage holder. Unit shall mean that portion of the Condominium intended for individual ownership and use as more particularly described in the D eclaration and shall in clude the undivided ownership in the Common Elements assigned to the Unit by the Declaration.

2 AMENITIES AND FEATURES A. BICYCLE RACK A bicycle rack is located under the stairwell on the Motor Lobby level for use of Owners and Occupants. Bicycles should be locked and are stored at the owner's risk. B. BUSINESS CENTER The Business Center is located on the fifth floor near the elevator and is available for use by Owners and Occupants. The key may be obtained from the Concierge. The Center is equipped with a desktop computer, laser printer, and a fax machine. A calling card must be used to dial long distance fax numbers. Faxes may be received in Business Center at the following number: FAX NUMBER: (404) 231-1995 C. CABLE AND INTERNET Digital cable television and high speed Internet services are provided by COMCAST to each Unit. Both services are paid from the Owners' m onthly assessment to the Association. D. CARTS Carts are provided in the Motor Lobby for the exclusive use of Owners and Occupants. After use carts must be returned to the Motor Lobby within 30 minutes; they should not be left in the el evator, ha llways, Motor Garage or in individual condo miniums. Use and location of carts will be mon itored by the Concierge staff. Fines wi ll be assesse d for violation of these rules. E. CLUB ROOM The Club Room is available for use by Owners, Occupants and their guests. A deposit is required to reserve the Club Room for exclusive use. The deposit is refunded if inspection by the Concierge shows that the area is cleaned and all items are in place. F. CONCIERGE Concierge services are available: Monday-Thursday 9:00 AM to 9:00 PM; Friday-Sunday 9:00 AM to Midnight. The Concierge can be reached at (404) 231-1991 or by dialing 000 from the call box at the gate or at the front door entrance. When the Concierge is not at the front desk he/she may be pa trolling the building, or pro viding assistance. During these brief p eriods the Concierge has a cell telephone which automatically rings over from the call boxes and from the above telephone number. G. DRY CLEANING PICK-UP SERVICE A lo cal company picks u p and drops off dry clea ning three times a w eek. See the Concierge for details.

3 H. FIREPLACES Units have gas fireplaces with an electric starter switch located on the wall next to the fireplace. Fireplaces can only be used during cold weather months. To manage costs the Association has gas fed pilot lights turned on during EST (November to March). The gas utilities are paid for through the Owners monthly assessment to the Association. I. FITNESS CENTER Hours of Operation: OPEN 24 Hours a Day; 7 Days a Week • Owners, Occupants and their guests use equipment at their own risk. Bring a towel to wipe down the equipment after use. • No one under the age of sixteen (16) is allowed in the Fitness Center without adult supervision. • The Fulton C ounty Health Departme nt prohibits GLASS CONTAIN ERS in the Fitness Center. • Workout type of apparel required to be worn. J. GAS GRILL A gas grill is located on the sundeck and pool area for use by Owners, Occupants, and their guests. A reservation is required for exclusive use for gatherings. A deposit required with the reservation is refundable if everything is left in proper order. If the grill is used, it must be thoroughly cleaned. Grilling of any kind is prohibited in any other part of the Le Château Condominium Property including in Common Elements or Limited Common Elements (this includes balconies and patios). K. PARKING SPACES Every Unit has been designated permanent vehicle space assi gnments. These assignments have been recorded and are a part of the Declaration of Condominium for Le Château. L. PEST CONTROL Each Unit i s provided quarterly pe st control treat ment. Th e Concierge will notify ea ch Owner or Occupant of the sche duled service. Permission must be granted for the Concierge to escort the technician into a Unit. M. PET PARK The Pet Park is the only area designated for use by pet owners and their pets. Owners must pick up and dispose of pet waste in the provided container.

4 N. REFUSE AND RECYCLING Trash disposal chutes are located on each floor in a closet across from the elevators. Only bags that are tied closed can be put down the chute. Large items must be placed directly into the dumpster located adjacent to the Motor Lobby exit. Do not place loose garbage down the trash chutes - this is a health hazard. Small boxes must be broken down before placing them in the dumpster. Moving boxes can not be disposed of in the dumpster or left in the trash or dumpster room. Recycling containers are located in the Motor Garage. Containers are marked to indicate the material that can be recycled which includes newspapers, glass, plastic, and cans. DO NOT use the recycle containers for mail, magazine or garbage disposal. O. SWIMMING POOL Pool Opens: Memorial Day (unless otherwise noted) Pool Closes: End of September Maximum Capacity for the Sundeck, Pool, and Club Room combined is 100 persons Hours of Operation: 9:00 AM to 10:00 PM EMERGENCY TELEPHONE is located on a Red Call Box on the Exterior Wall outside the Club Room • By the order of the Fulton County Health Department, NO GLASS CONTAINERS are allowed in the pool area. The pool is for the exclusive use of Le Château Owners, Occupants, and their guests. • Occupants and their guests swim at their own risk. There are NO LIFEGUARDS on duty. • Any guest using the pool must be accompanied by the Owner or Occupant at all times. • No children under twelve (12) are permitted in the pool area without adult supervision • Proper bathing attire is required in the pool. • Children may not wear dia pers in the po ol. Young children who are not potty trained must wear plastic swim pants while swimming by order of the Fulton County Health Department. • Pool party reserv ations for exclusiv e gatherings must be approved by Le Château Board of Directo rs. Submit a reserv ation request t o the Con cierge two weeks in advance of the requested date. • The host must be present whenever their guests are using the pool. • Drink responsibly in the pool area. • No bicycles, roller skates or roller blades, skateboards, scooters, or pets are permitted in the pool area. • Anyone using the pool or sundeck must put all furniture, grill and other items back in their designated locations after use, and place all trash in receptacles.

5 P. VISITOR PARKING Visitors may park for a period of not more than 48 hours in the non-reserved spaces at the front of the building. Visitors parking on the property for longer than 48 hours must obtain a temporary parking permit from the Concierge; the permit must be return ed to the Concierge at the end of the visit.

6 POLICIES AND PROCEDURES 1. ABANDONED PERSONAL PROPERTY Personal property that is allowed to remain for more than 24 hours in any of the Common Elements is considered abandoned. No personal property (other than authorized vehicles) should be placed within or near parking spaces without approval of the Board of Directors. The Board of Directors will place a written notice of the infraction on the personal property and/or on the front door of the prope rty owners' un it, if known. If the p roperty is not removed within 48 hours after the notice is issued, the Board has the right to remove the property. The Association is under no obligation to return, replace or reimburse the owner of the property. The Owner is also responsible for the cost of the removal, if any, and may be subject to a fine. If the Association deems the abandoned property to constitute an emergency, the property may be removed immediately without prior notice to the property owner. 2. ACCESS TO PROPERTY Gate and building access is recorded 24 hours a day via security cameras strategically located throughout the property, swipe card and remote clicker use, and phone access through call boxes. All information is recorded and stored for security purposes. Owners and Occupants may access the front gate by using their remote control "clicker" or their security card. The building can be accessed only with the security card which will open the front door, Motor Lobby door, Fitness Center, and side entrance to the 1st floor. All Owners and Occupants should contact the Concierge staff for information on obtaining initial and/or replacement clickers and cards. Visitors/guests gain access to the gate and building by entering the Owner/Occupant access code which is programmed by name into the respective call boxes. Access codes can be prog rammed only to local p hone numbers. Occupants ne ed to provide t he Concierge a local telephone number to set up an access code. To admit visitors/guests who dial the access code from the front gate, simply dial "55" on the telephone keypad while still connected to the call and the gate will open. For entrance to the front door, the visitor/guest will dial the access code from the call box; while still connected dial "99" from the telephone keypad to admit them. Only calls placed from the call boxes will permit remote access through the gate or front door. 3. ANTENNAS AND SATELLITE DISHES No satellite dish and/or antenna shall be erected, used or maintained on any portion of the Common Elements or Limit ed Common Elements of the Le Château Condominium property.

7 4. ARCHITECTURAL CHANGES, RENOVATION & CONSTRUCTION PROCEDURES See Addendum A 5. ARCHITECTURAL CONTROL No Owner, Occupant or other person may make an encroachment onto the Common or Limited Common Elements, or make any ex terior change, alteratio n, or construction without first obtaining the written approval of the Board of Directors. Additionall y, no Owner, Occupant or other person may make any alteration within a Unit which involves connecting to Common Element pipes, lines, conduits and/or other apparatus for access to common utilities and/or placing an excessive load on any structural or load bearing portion of a Unit without prior written approval of the Board of Directors. Nothing may be hung or d isplayed, nor any sig ns (including realtor signs), awnings, canopies, shutters, antenna, satellite dishes or other device or ornament be affixed to or placed upon the exterior walls, doors, windows, fences, roof or balconies and patios. Modifications made without the written approval of the Board of Directors are done at the Owner's risk. The Board can require that any modification be removed and/or restored to its original condition at the Owner's expense. If an Owner fails to comply with the rules and regulations set forth herein with respect to architectural control and/or provisions for renovations and construction set forth in Addendum A, the Association reserves the right of abatement to enter the Owner's property, remove the violation, and restore the property to its orig inal cond ition. All costs associated w ith restoring t he property, including attorney's fees and rehabilitation costs, are assessed against the Unit. Architectural Controls, including the above, are more fully described in Paragraph 13 of the Declaration of Condominium. 6. ASSESSMENTS AND PAYMENTS Assessments are due and payable on the 1st day of each month. Monthly assessments not paid in full by the 10th day of the month are charged a late fee of 10 per cent of the amount not paid, plus interest. On the 11th day late assessments will be turned over to the Association's attorney to institute legal collection procedures. Special assessments are to be paid based on the terms established for the assessment. This information will be communicated to each Owner by written communication. 7. BALCONIES AND PATIOS No objects other than potted plants and patio furniture shall be placed on a balcony or patio. This prohibition applies to objects such as, but not limited to, gas and charcoal grills, umbrellas, bicycles, laundry garments, towels, and objects other than potted plants and patio furniture. 8. BICYCLES Occupants shall not store bicycles on balconies. Nor may bicycles be secured to fences, railings, poles or other items in Common Elements. A bicycle rack is located under the stairwell on the Motor Lobby level. 9. COMBINE TWO ADJACENT UNITS An owner may combine two (2) adjacent units into one (1) unit as set forth below: Paragraph 13 (C) (i) of the Declaration provides that "notwithstanding the above, if any Owner acquires an adjoining Unit, such Owner shall have the right (subject to prior written approval of the Mortgagee s of the units involve d) to remove all or any part o f an intervening partition or to create doorways or other apertures therein, notwithstanding the fact that such partition may, in whole or part, be part of the Common Elements, so long as no portion of any structural or load bearing portions of the Unit(s) are materially weakened or removed and the Board of Directors has approved the plans described above and no portion of any Common Elements is damaged, destroyed or endangered, other than the partition and any chutes, flues, ducts, conduits, wires or other apparatus contained therein which shall be rel ocated by such Ow ner if such facilities serve any other p art of th e Condominium." An Owne r, who owns two (2) a djoining Units, has the right to remove the partition s between the two (2) Units so long as the Owner does not harm the structural integrity of the Condominium. However, if the partitions are removed with the two (2) units effectively operating as one (1) unit, under the Declaration, for purposes of the assessment obligation and votes in the Association, the units shall legally remain two (2) separate units. Architectural Controls, including the above, are more fully described in Paragraph 13 of the Declaration of Condominium. 10. CONDOMINIUM ASSESSMENTS AND PAYMENTS See Assessments and Payments

9 11. CONDOMINIUM GOVERNING DOCUMENTS Owners should have received a copy of the Le Ch âteau Declarati ons and Bylaws at closing. Replacement or additional copies may be purchased from the Association. The Declarations and Bylaws set forth the rules and regulations that govern the Le Château Condominium Association. 12. DESIGNATED PARKING See Parking Rules and Regulations Addendum F 13. EMERGENCY PROCEDURES See Addendum B 14. FIREARMS AND FIREWORKS The display or discharge of firearms or fireworks is prohibited on the Common Elements and Limited Common Elements. Firearms include BB guns, pellet guns, and other fire arms of all types, regardless of size. 15. FLOORS AND FLOORING REPLACEMENT See Architectural Changes, Renovation and Construction Procedures 16. GARAGE SALES Garage sales, flea markets, yard sales, or similar activities are prohibited. 17. GRILLING Any use of outdoor grills, except those grills maintained and provided by the Association, is strictly prohibited. R efe r to AMENITIES fo r informati on on reserving the Club Room, swimming pool and grill. No grill is allowed on the balconies or patios. This is a fire code violation 18. HAZARDOUS MATERIAL No Owner or Occupant shall store any explosives, flammable, odorous, noxious, corrosive, hazardous, or pollutant mat erials o r any other goods which would cause danger or nuisance to the Condominium. 19. HEATING AND COOLING SYSTEMS a. Installation, Repair and Maintenance Owners and Occupants must contact the Concierge before scheduling installation, repair or maintenance of their heating and cooling system. In order to preserve the roof warranty the Le Château Maintenance Engineer must accompany service personnel onto the roof for them to work on heating and cooling systems. When the Maintenance Engineer is on the property during his/her regular schedule there is no charge to the Owner/Occupant for his/her time. However, if the Maintenance Engineer is brought to the property on an off-scheduled day, the Owner/Occupant is charged the Heritage Property Construction and Maintenance hourly rate for his/her time.

10 b. Heating in Colder Months Whenever the temperature is forecasted to, or does reach, 32° Fahrenheit or below, all Owners and Occupants are expected to maintain the thermostats in the Unit with the heat in an "on" position and at a minimum temperature setting of 55° F or higher . This is required to prevent breakage of water pipes during colder months of the year. 20. INSURANCE Owners are responsible for property and liability insurance for their Unit. All Owners are obligated to maintain at all times insurance covering those portions of their Unit to the extent not insured by policies maintained by the Association. In securing coverage the Association recommends that Owners share the guidance prepared by the Association's legal firm (Addendum C) wi th their insurance company to assure that their policy is structured to provide adequate coverage. Owners must provide the Association a copy of their insurance policy not later than 30 days after the purchase of their Unit and annually thereafter. If the Owner fails to obtain insurance as required, the Association may purchase such insurance on behalf of the Unit Owner and assess the cost thereof to the Owner. Reference: Declarations Section 2, Number 11, pages 11 through 14 21. KEY RELEASE A Key Release Form is available from the Concierge staff. When an Owner or Occupant signs this form it authorizes the Association to provide access to the Unit for the specific period stated on the form. 22. LEASING An Owner's request for a leasing permit shall be approved if current, outstanding leasing permits have not been issued for more than the total number of lease permits allowed by the Le Chât eau Declara tion of Condominium, and th e Owner is curre nt with all assessments. Condominium leases must be executed in accordance with Declaration of Condominium Section 2, Number 15-a, b, c, and d, pages 26, 27, and 28. Owners desiring to lease their Unit should thoroughly read these provisions prior to submitting a written request to the Board of Directors for a Leasing Permit. Units must be leased in their entirety for a term not less than one year, and may not be sublet. Units may be leased only after the Owner has applied for and received a "Leasing Permit" from the Board of Directors. It is incumbent upon the Owner to validate the character and financial reliability of persons to whom they lease to insure that the community's integrity and financial well-being is protected. (Addendum D) All tenants must schedule a Tenant Orientation briefing with Board of Directors prior to move in.

11 23. MAILBOXES Mail boxes are located in the Motor Garage. Outgoing letters may be dropped in the black box attached to letter boxes, or in the front slot provided for that purpose. Please discard unwanted advertisements in the trash receptacle next to the Motor Lobby door; do not place on top of the letter boxes. 24. MAINTENANCE AND REPAIR a. Proof of Insurance Owners and Occupants who hire a service contractor to do maintenance or repair work must provide the Association with a copy of the service company's proof of insurance. No uninsured contractor and/or ve ndor will be allow ed to perform work on the property. Owners and Occupants who violate this rule are responsible and financially liable for any damages caused by the contractor or vendor. b. Plumbing Work Before any plumbing work is performed in a Unit, the Owner/Occupant must contact the Concierge to have the main water line turned off. This is to avoid possible mishaps that can occur during plumbing servicing. Except for emergencies, plumbing work should be schedul ed 72 hours in advance to a llow prope r notification of a ffected Owners/Occupants. 25. MOVING IN/OUT RULES AND REGULATIONS The dates for moves into and out of the property must be reserved through the Concierge staff. Reservations are on a first-come-first-served basis. Onl y one move in/out is scheduled per day. See Addendum E for complete details. 26. NOISE Noise from devices such as sound systems and televisions should not be so loud as to disturb neighbors. Where possible, speakers should be positioned away from walls that abut another Unit, and the volume shall be adjusted to ensure that the sound is limited to the Unit. If the sound can be heard in the hallway, it is too loud. Loud voices (generated by such activities as disagreements, parties, etc) should also not encroach on neighbors. Le Château Condominium Declaration of Condominium requires that at least 50 per cent of all wood floor surfaces within a Unit (except entrance foyer, kitchens and bathrooms) must be covered with area rugs or carpet. 27. NOXIOUS ODORS, DESTRUCTIVE OR OFFENSIVE ACTIVITY Activities that are deemed noxious, destructive, or offensive shall not be carried on within any portion of the Condominium.

12 28. NUMBER OF OCCUPANTS The maximum number of occupants permitted to reside in a Unit shall be limited to two (2) people per bedroom in the Unit, (as such bedrooms depicted on the original Survey and Floor Plans filed in the Fulton County, Georgia records). Sixty condominiums are two-bedrooms and six are one bedroom condominiums. 29. OCCUPANTS See Owner's Responsibility for Occupants and Guests 30. OWNER RESPONSIBILITY FOR MAINTENANCE Owners are obligated to maintain and keep in good repair all portions of their Unit and all improvements made by the Owner to the Limited Common Elements assigned to the Unit. This maintenance responsibility includes, but is not limited to, all glass surfaces, windows, window frames, casings and locks; all doors, doorways, doorframes, and hardware that are a part of the entry system of the unit; all portions of the heating and air conditioning system, including the air conditioning compressor and the fan coil servicing the Unit; and all pipes, lines, ducts, conduits, or other apparatus which serve only the Unit, whether located within or without a Unit's boundaries (including all electricity, water, sewer, or air conditioning pipes, lines, ducts, conduits, or other apparatus serving only the Unit). 31. OWNER RESPONSIBILITY FOR OCCUPANTS AND GUESTS Owners are responsible for ensuring that their Occupants an d guests comply wi th all provisions of the Le Château Declaration of Condominium and Bylaws. In cases of violations, the Association may take a ction against the Owner fo r violatio ns by th eir Occupants and guests. 32. PARKING RULES AND PROCEDURES See detailed parking rules and procedures in Addendum F Vehicles parked in violation of the rules described in Addendum F are subject to being tagged, and towed. The owner is responsible for all associated costs. 33. PET RULES AND REGULATIONS See Addendum G 34. RENOVATION AND CONSTRUCTION See Addendum A 35. SALE AND PURCHASE OF CONDOMINIUMS When a Unit Owner places his/her Unit for sale and purchase they must, within seven (7) days before placing it on the market, give written notice to the Board of Directors of such intention. If a real estate agent is brokering the sale, there must be a lock box on the door of the Unit. If the Unit is for sale by Owner, the Owner must make arrangements for prospective buyers to be granted access to the Unit. The Concierge staff is not authorized to grant access to a Unit for sale and purchase.

13 Admission hours to Le Château Condominium Property for viewing a Unit for sale and purchase will be governed by the seasons. Fall and winter the hours are 10:00 AM to 5:00 PM. Spring and summer the hours are 10:00AM to 7:00 PM. Open houses must be approved by the Board of Directors. Seven (7) days before the proposed date a written request must be submitted to the Board of Directors. A Unit Owner intending to make a transfer or sale of a Unit or any interest in a Unit shall give written notice to the Board of Directors of such intention within seven (7) days after execution of the transfer or sales documents. The Unit Owner shall furnish to the Board as part of the notice (i) the name and address of the intended grantee; and (ii) such other information as the Board may reasonably require. This paragraph shall not be construed to create a right of first refusal in the Association or in any third party. Within seven (7) days after receiving title to a Unit, the purchaser of the Unit shall: a. Give written notice to the Board of Directors of his or her ownership of the Unit. Upon failure of an Owner to give the required n otice within th e seven (7) day time period provided herein, the Board may levy fines against the Unit and the Owner thereof, and assess the Ow ner for all cost s incurred by th e Association i n determining his or her identity. b. Schedule an Owner Orientation briefing with the Board of Directors prior to move in. 36. SATELLITE DISHES See Antenna and Satellite Dishes, above. 37. SECURITY Le Château Condominium is a restricted access property. Owners and Occupants must verify the identity of persons th ey admit to the property. Fo llow Access and Sig n in procedures in Addendum H. 38. SIGNS Except as provided below, no signs, advertising literature, political placards, billboards, realtor sig ns, or other notices will be placed o r posted i n or around the Le Château Condominium Property (including on windows, fences, or areas at the main entrance to the property). Open house signs may be posted outside the main entrance gate one day prior to and on the day of a scheduled open house. 39. SMOKING Smoking is prohibited in th e interior building Common Elements of Le Château Condominium Property. Do not discard smoking material, including butts on the property. Offenders are subject to a $100.00 fine per incident.

14 40. SPEED LIMIT ON PROPERTY No vehicle shall exceed a rate of speed of 10 MPH. Owners, Occupants, and their guests who violate this speed limit are subject to fines imposed by the Association. 41. SPORTS Recreational sports, including, but not limited to, rollerblading, skateboarding, baseball, basketball, and football are prohibited on sidewalks, parking areas, the swimming pool area, and throughways. 42. SWIMMING POOL See AMENITIES 43. UNSIGHTLY OR UNKEMPT CONDITIONS Owners, Occupants, and their guests are expected to refrain from hobbies or pursuits that might cause disorderly, unsightly, or unkempt conditions. This includes assembly, or disassembly of motor vehicles or other devices. Owners and Occupants shall not store items outside their Units in the Common or Limited Common Elements (including their balconies and patios). 44. USE RESTRICTIONS Each Unit shall be used for residential purposes only, and no trade or business of any kind may be conducted in or from a Unit or any part of Le Château Condominium Property, except that the Owner or Occupant residing in the Unit may conduct ancillary business activities within the Unit so long as: a. The existence or operation of the business activity is not apparent or detectable by sight, sound or smell from outside of the Unit; b. the b usin ess activity d oes not involve visitation of the Unit by em ployees, cl ients, customers, suppliers or other business invitees in greater volume than would normally be expected for guest visitation to a residential Unit without business activity; c. the business activit y is legal and conf orms to all zoning re quirements for the Condominium; d. the business activity does not increase traffic in the Condominium in excess of what would normally be expected for residential un its in the Condominium without business activities, (other than by a rea sonable number of deliveries b y couriers, express mail carriers, parcel delivery services and other such delivery services); e. the business activities does not increase the insurance premium paid by the Association or otherwise negatively affect the Association's ability to obtain insurance coverage; f. the business activity is consistent with the residential character of the Condominium, and does not constitute a nuisance or a hazardous or offensive use, or threaten the

15 security or safety of other residents of the Condominium, as determined in the Board's discretion; and g. the business activity does not result in a materially greater use of Common Element facilities or Association services. 45. UTILITIES AND TELEPHONE SERVICE Owners and Occupants are responsible for paying their own electric power, water and sewer, and teleph one usage. These expenses are not paid by th e Le Château Condominium Association. 46. VEHICLES See Parking Rules and Regulations above, and Addendum F 47. VISITORS See Owner's Responsibility for Occupants and Guests 48. WINDOW CLEANING The exterior windows of the building are cleaned and paid for as an Association expense and will be conducted when the budget allows. 49. WINDOW SCREENS All windows are required to have exterior screens installed and they must be properly maintained. This is the responsibility of the Unit Owner and is not an Association expense. 50. WINDOW TREATMENTS All windows are required to have treatments. Window treatments must be white or off-white when visible from outside the Unit. Bed sheets sh all not be used as window treatments. No items may be propped up against or inserted in the window (with the exception of a window screen) that is noticeable when visible from outside the Unit. As an example: no pillows, books, electric window fans etc.

A-1 ADDENDUM A ARCHITECTURAL CHANGES RENOVATION AND CONSTRUCTION PROCEDURES The rules below are approved by the Le Château Board of Directors for any renovation and construction activity. 1. Application for Construction or Renovation Permission. Unit Owners wishing to perform renovations and/or construction within a Unit must first submit to the Le Château Board of Directors an Architectural Changes Application form (Format attached). Board approval is required prior to start of construction. 2. A No n-Refundable Application Fee of $100.00 is required to accompany the Architectural Changes Application form. If the fee is paid for by check, the Board must confirm clearance of the payment prior to start of construction. Any expenses incurred by the Association as a result of th e const ruction and /or renovati on may be specifically assessed against the Unit owner. 3. Damages. Owners and their contractors are responsible and financially liable for any damage(s) caused by their construction and/or renovation. This includes damage(s) to the Common Elements, and/or other Owner units. 4. Insurance. Owners and Contractors must provide the Board of Directors with proof of insurance and the contracto r's Bond prior t o commencement of any construction. Construction Insurance: Con tract ors or subcontractors who have a ccess to the Condominium for the purpose of making repairs or improvements to Units are required to obtain and maintain the followin g minimum coverage: General commercial lia bility coverage for bodily injury and property damage with a combined single limit in an amount not less than One Million Dollars ($1,000,000.00) and worker's compensation insurance to the extent required by applicable law. Such policy must h ave the L e Château Condominium Association as a loss payee. 5. Requirements and Restrictions. a. Owners a nd Contractors must conduct all co nstruction, remodeling and renovation activities within the Owner's Unit. Owners and Contactors are prohibited from using all Common Elements for construction (i.e. hallways, garage, common area electrical outlets, etc). b. No Owner shall make any interior modifications to or place an excessive load on any structural or load bearing portions of a Unit without first obtaining the prior written approval of the Board of Directors. Such approval shall not be granted by the Board of Directors unless the Owner has presented to the Board of Directors a report or drawing prepared by

A-2 a licen sed structural engineer sho wing that compensating measures will be taken to ensure the structura l integrity o f the Unit and the C ondominium. All building cod e requirements must be complied with and necessary permits and approvals secured for any modifications. 6. Replacing Carpet with Tile or Hardwood Flooring. Owners desiring to replace carpet with tile or hardwood floors must obtain the prior written consent of the Le Château Board of Directors The replacement option will not cause noise levels to any Unit below which exceed the average noise level in the Units with carpeted floors. The weight of such proposed flooring must be appropriate and will not cause problems to structure or sub-flooring. 7. Use of Common Element Utilities. a. Owners w ishing to perform any ren ovation or construction work to connect to any Common Elements utility lin es, (such as water lines and e lectrical lines), must su bmit written notice to the Le Château Board of Directors at least 5 days prior to such work being performed. b. Any necessary wa ter shut off/turn on must be performe d by the Associa tion's maintenance staff and/or preferred vendor. Any requirement for the maintenance staff and/or vendor to come to the property for this service will be billed directly to the Owner at the hourly rate of person(s) providing the service. c. All major electrical modifications must be submitted by an electrical engineer and the work performed by a certified, bonded and insured electrical contractor; who must provide his insurance credentials to the Board of Directors prior to commencing any work in the building. 8. Work Hours for Construction. Except as provided herein, all construction work is restricted to Monday through Friday between the hours of 9:00 AM and 5:00 PM (unless otherwise approved by the Board of Directors.) Quiet work such as painting may be done on Saturdays between the hours of 10:00 AM and 4:00 PM provided there is no use of equipment such as generators or other machines that generate a noise. Elevators may not be used on Saturday to transport equipment or supplies required for any aspect of the construction work. No construction work of any kind is permitted on Sunday. 9. Transportation of Construction Materials. Materials will be transported into the condominium only via the motor lobby. Additionally, use of the elevators and/or the internal stairwells to transport construction materials must receive the prior written approval of the Board of Directors. For items determined to be acceptable to be transported via the elevator, the Owner must give at least 72 hour notice to reserve such elevator. Once approval is granted the elevator will be locked down and padded by the Concierge for use by construction personnel. Workers may not use carts located in Motor Lobby to transport equipment or materials. 10. Debris and Materials. a. Owners are re sponsible for the proper removal and disp osal of al l debris and materials associated with renovations and construction within a Unit. Construction debris must not be left in the Common Elements, must not be disposed of in the trash chute, nor

A-3 placed in the Le Château trash receptacle/dumpster. A construction dumpster cannot be placed on the property without prior approval from the Board of Directors. b. Owners' doors must remain closed during construction to avoid dust, fumes or noxious odors from being discharged into the Common Elements. Owners must ensure that all Common Elements, including without limitation, the hallways, elevators, stairwells, and motor lobby are cleaned and restored back to its original condition after each workday. 11. Notice to Board of Directors. Owners must give the Association at least 72 hour written notice of the proposed schedule for their Contractor to perform work on their Unit. This is to ensure that the Association is given ample time to approve the schedule and notify other Occupants about the impending renovations and/or construction. 12. Commencement and Completion of Construction. a. All changes, modifications and improvements approved by the Board of Directors must be commenced within six (6) months from the date of approval. If not commenced within six (6) mont hs from the date of such ap proval, then such approval shall be deemed revoked by the Board of Directors, unless the Board of Directors gives written extension for commencing the work. All work approved by the Board of Directors shall be completed in its entirety not later than (90) days from the date of commencement, unless otherwise agreed in writing by the Board of Directors. b. All approved changes, modifications, and improvements must be completely in their entirety. An Owner may not con struct on ly a portion or part of an ap proved change , modification or improvement.

A-5 EVACUATION PLAN Le Château Condominium Association is committed to providing a safe environment for our Occupants. The storage of any equipment in the hallways is a fire safety hazard and a violation of local codes. Any fines resulting to the Association as result of a violation of building and/or fire codes could result in an assessment against the Owner of the unit for the amount of the fine plus a penalty. KNOW YOUR BUILDING Each occupant should be familiar with the location of all the exit stairways on their floor. In addition, occupants should determine in advance what to do if the nearest exit cannot be used during a fire emergency. IF A FIRE OCCURS IN YOUR HOME a. Call 911 for the Fire Department. Give them: street address, floor and unit number. b. Evacuate your home immediately. Be sure to close the door behind you, leaving it unlocked. This will prevent the possible spread of heat and smoke into the corridor. c. If possible, alert occupants of other Units on your floor. d. Do NOT use elevators e. Use the nearest stairway exit. Close the stairway door behind you. f. There are three sets of stairways: (1) Across from the elevator bank; (2) at the north end of each hallway - on the pool side of the building; (3) on the south end of the building toward Buford Highway. NOTE: The south end stairway leads to the first floor level. There is no exterior exit from the first floor south-end stairway. PHYSICALLY CHALLENGED OCCUPANTS a. Persons with inability to walk have difficulty walking, or who rely on mobility aids, such as canes, walkers, scooters, or wheelchairs. b. Persons with sight or hearing disabilities c. Persons who have difficulty interpreting or receiving sensory information d. Persons with lack of stamina to exit stairwells It is the responsibility of the Occupant to notify the Association of their special needs and condition s. Please refer to and complete the form for Physically Challenged Individuals and turn it into the C oncierge. The Concierge desk will main tain a list of physically challenged Occupants to be used to assist the Fire Department in the event of an emergency.

A-10 ADDENDUM D LEASING 1. Leasing condominiums is prohibited except as provided by Declaration of Condominium Section 2, Number 15-a, b, c, and d, pages 26, 27, and 28. Owners desiring to lease their Unit should thoroughly read these provisions prior to submitting a written request to the Board of Directors for a Leasing Permit. Units may be leased only after the Owner has applied for and received a "Leasing Permit" from the Board of Directors. It is incumbent upon the Owner to validate the character and financial reliability of persons to whom they lease. 2. Units may be leased only in their entirety. All requests to lease must be in writing and must be approved by the Association Board of Directors prior to the effective date of the lease. Each unit can be leased only one time in any 12-month period. Sub-leasing is not allowed. All leases must be for a term of at least one (1) year. Within ten (10) days after the effective date of the lease, the Owner must provide the Board of Directors with a copy of the lease, and a copy of the Occupant Information form containing the name of the lessee and the names of all people occupying the Unit. The Owner is required to provide the lessee with a copy of the Condominium Declaration, Bylaws, and Rules. 3. Any Owner w ishing to lease his or her Unit must subm it a writt en Leasing Permit Request t o the Board of Directors. An Owne r's request for a leasi ng permit shall be approved if current, outstanding leasing permits have not been issued for more than the total number of lease permits allowed by the Le Château Declaration of Condominium, and the Owner is current with all assessments. Any lease of a Unit shall contain the following language, without limitation: a. The lessee acknowledges receipt of a copy of the Declaration, Bylaws and Rules; b. The lessee's agreement to abide by the provisions outlined in the Declaration, Bylaws and Rules; c. The lessee's agreement to control the conduct of all other Occupants a nd guest to ensure their compliance with the Bylaws and Rules. d. The Owner's agreement to be responsible for the compliance of the lessee, occupants and guests to all governing documents; e. The Owner's agree ment to be responsi ble for u npaid fines, including those of the lessee, lessee's occupants, and guests

The lessee acknowledges that violations of the governing documents by lessee, lessee's occupants, or guests constitute a default under the lease and authorizes the Owner or the Association to terminate the lease and evict the lessee in accordance with Georgia law. g. The Owner delegates and assigns to the Association and its Board of Directors the power and authority of enforcement against the lessee for violations and the power and authority of eviction. h. Any Own er who is leasing his or her Unit and fa ils to pay any annual or special assessment agrees to the assignment of any rent from the lessee to the Association. Any expenses and fines incurred as a result any of the above described actions will be an assessment against the Owner of the Unit and, if not paid timely, will be placed as a lien against the Unit. [Reference: Section Two, Number 15 of the Declaration entitled "Leasing"]

A-12 ADDENDUM E MOVING IN/OUT RULES AND REGULATIONS Elevators must be reserved and used for moving furniture and oversized items in to or out of Le Château Condominium. Moves may be done only during the hours specified below. Move in and out hours: Moving in or out is permitted only Monday through Friday between the hours of 9:00 AM and 5:00 PM. No move in or out may occur during the holidays. Elevators for moves must be reserved at least seven (7) business days in advance by contacting the: Concierge staff of Le Château (404) 231 1991 or (404) 231-1993 Any move that runs past 5:00pm without the approval of the Board of Directors or Heritage Property Portfolio Manager is subject to a $250 fine. Prior to Move: At the time of the either the move into or move out of Le Château, the Owner or Occupant must provide the Association with a $500 damage deposit as outlined in the Moving In/Out Rules and Regulations. The $500 damage deposit is refundable if there is no damage after the post-move inspection. The $500 damage deposit is in addition to the non- refundable $500 moving fee that is payable at the time an Owner or Occupant moves into the property. If a movi ng comp any is used, the Associ ation requires that a valid certifica te of insurance must accompany the move request form and prior to allowing the movers access onto the property or into the building. Schedule and coordinate a move date and time with the Concierge and th e mover. Reservations are scheduled on a first-come, first-served basis. And, only one move is allowed per day. The Concierge will reserve one elevator for exclusive use, will have it padded, and will post a notice showing that the elevator is reserved for moving. The Owner or Occupant must contact the Concierge prior to the arrival of the moving van so that the gates at the entrance are opened. The Concierge staffer will direct the movers to the proper location to park and instruct them where to load and unload. The driveway and parking spaces must be kept clear and unobstructed. No trucks/van may be backed adjacent to the building.

A-13 Before the move b egins and be fore the padding is put into place in the elev ator, the Concierge will annotate on a diagram of the elevator any existing scratches or other flaws in the designated elevator. Non-Refundable Fee: The non-refundable fee of $500.00 must be submitted with the Move-In Request form at the time of requesting to move into Le Château. The check or money order must be made payable to the Le Château Condominium Association. Damages: The Concierge on duty will conduct the post-move inspection, and a Board member will visually confirm any damages noted. Repair of damages will be assessed against the unit and the respon sibility of the person(s)) moving into or out of t he uni t. A copy of the expenses billed to the Association by contractor(s) for estimates for actual work done will be provided to the person(s) responsible for the damage(s). Special Note: Owners must be aware that they are ultimately responsible for the damage(s) if the Occupant is their Tenant and that Tenant does not comply with the Rules and Regulations. Restrictions During Move: An oversized item, i.e., any item that does not fit securely within either one of the moving carts or luggage racks provided by Le Château, may not be transported in the Le Château grocery or luggage carts. An item is oversized if it extends beyond the side, front or back of either of these conveyances, or is taller than the height of the luggage carts. Furniture items can not be moved in or out on the luggage carts. All items mus t be wheeled or carried thr ough the c overed parking deck and in through the Motor Lobby. Items in crates must be removed from their crates before they are allowed into the elevators. No furniture or other oversized items shall be moved through the first floor lobby except as necessary to move between an elevator and a residence located on the first floor. Completion of the Move: Upon completion of the move the Concierge will remove the padding and inspect the elevator for damages.
