Veroilla tarkoitetaan tiissUi sopimuksessa julkisia maksuja, mikdi niit&i kannetaan Suomen Tasavallassa valtiolle ja Saksan Valtakunnassa valtakunnalle ja osavaltioille, sek. kummassakin sopimusmaassa yhdenmukaisesti mainittujen maksujen kanssa suoritettavien lisdmaksujen tai apumaksujen muodossa muiden julkisoikeudellisten yhdyskuntien hyvaiksi. Suomen kunnalisveroa pidetdidnu my6s tdlsst sopimuksessa tarkoitettuna verona. Tullit ja kulutusverot ovat tiimln sopimuksen ulkopuolela. Liikevaihtoveroa ei tisstl sopimuksessa pidet, kulutusverona. Arvon- nousuveroihin, joita on suoritettava kiinteist6jen luovutuksen johdosta, sovelletaan tftt sopimusta silloinkin, kun ne kannetaan ainoastaan kunnille tai kuntien ifitoille.

I. OIKEUSSUOJA VEROASIOISSA.

RECHTSHILFE IN STEUERSACHEN. GEZEICHNET IN HELSINKI,

AM 25. SEPTEMBER 1935.

of Nations. The registration of this Convention took place November ioth, 1936. DFR DEUTSCHE REICHSKANZLER und DER PRXSIDENT DER REPUBLIK FINNLAND sind iiber- eingekommen, cin Abkommen fiber Rechtsschutz und Rechtshilfe in Stcuersachen abzuschliessen. Zu diesem Zwecke haben zu Bevollmaclhtigten ernannt:

DER PRASIDENT DER REPUBLIK FINNLAND :

den Verwaltungsrat Eemil Leander AIRILA, die, nachdem sic ihre Vollmachten gepriift und in guter und geh6riger Form befunden haben,tiber folgende Bestimmungen iibereingekommen sind:

Artikel I.

Als Steuern im Sinne dieses Abkommens gelten die 8ffentlichen Abgaben, soweit sic auf seiten des Deutschen Reiclis filr das Reich und die Lander, auf seiten der Republik Finnland fiir den Staat und auf beiden Seiten in der Form von cinheitlich mit diesen Abgaben zu erhebenden Zuschligen oder Beitrdigen ffir Rechnung anderer 6ffentlich-rechtlicher K6rperschaften erhoben werden. Die finnische Gemeindesteuer gilt ebenfalls als Steuer im Sinne dieses Abkommens. Ausgeschlossen sind jedoch Z611e und Verbrauchsabgaben ; die Umsatzsteuer gilt ffir den Anwen- dungsbereich dieses Abkommens nicht als Verbrauchsabgabe. Auf Steuern vom Wertzuwachs bei der Verausserung von Grundstiicken findet das Abkommen auch dann Anwendung, wenn sic nur fir Gemeinden oder Gemeindeverbande erhoben werden.

I. RECIITSSCHUTZ IN STEUERSACHEN.

Artikel 2.

(I) Die Angehbrigen des inen Staates geniessen im Gebiete des anderen Staates die gleiche steuerliche Behandlung, insbesondere den gleichen Schutz vor den Finanzbehrden, Gerichten, Finanz- und Verwaltungsgerichten, wie die Landesangeh6rigen. (3) Toisen valtion kansalaisia samoin kuin 2 kohdassa mainittuja verovelvollisia ei saa toisen valtion alueella veroasioissa kohdella epdiedullisemmin kuin mink'i muun kolmannen valtion tahansa vastaavanlaisia kansalaisia.

II. OIKEUSAPU VEROASIOISSA.

3 arlikla.

Molemniat valtiot sitoutuvat kaikissa veroasioissa, niin hyvin verojen perusteiden ja vakuuk- sien selvillesaattamisessa ja verojen ma'rdiimisessa kuin my6s muutoksenhakumenettelyssl ja verojen perimisessad antamaan toisilleen virka- ja oikeusapua.

4 artikla.

(i) Veroasioissa tapahtuu virka- ja oikeusapupyynt6jen, asiakirjain tiedoksi antamista koskevat asiat niihin luettuina, ksittely kummankin valtion viranoniaisten vdilittbmdn yhteis- toiminnan kautta. (2) Pitevlit tiedoksiantopyyntojd samoin kuin muita virka- ja oikeusapupyynt6ja valitt6m-isti lihettiqman ja vastaanottamaan ovat Suomen Tasavallan puolelta valtiovarainministerid ja Saksan Valtakunnan puolelta valtakunnan finanssiministeri (der Reichsminister der Finanzen).

5 artikla.

(i) Pyynt6kirjelmdt seka kaikki muut virka- ja oikeusapuasioissa toiseen valtioon 1Idhetettfvtit asiakirjat ja rnuut kirjoitukset laaditaan pyytzivan valtion virkakielclli. Suomen Tasavallasta Eihetettilvien pyyntdkirjelmien, asiakirjojen ja muiden kirjoitusten oheen on liitettdvii saksan- kieliren kdidnn6s. (2) Pyynt6kirjelmissa on mainittava pyytdvt viranomainen, asiallisten nimi ja ammatti (saidty) sekdi tiedoksiantoasioissa vastaanottajan osoite ja tiedoksi annettavan asiakirjan laatu.

6 arlikla.

(i) Tdytdnt68npanovaltion asianomainen viranomainen on velvollinen huolehtimaantiedoksiannosta. Timak viranomainen voi muissa paitsi 2 kohdassa edellytetyissii tapauksissa rajoittua siihen, etta hfin suorittaa tiedoksiannon jttmaIll asiakirjan vastaanottajalle, mikii tdilmi suostuu sen vastaanottamaan. (2) Pyytavan valtion toivomuksesta on tiedoksi annettava asiakirja toimitettava asianom- aiselle slind muodossa, mikil tdytfint6bnpanovaltion sisdisess-a lainsdaddnnbssft on samanlaatuisten tiedoksiantojen suorittamisesta marfitty.

7 artikla.

Tapahtunut tiedoksianto todetaan joko vastaanottajan antamalla vastaanottotunnustuksella, joka on paivttfivii ja varmennettava, tai tUytint66npanovaltion viranomaisen todistuksella, mist-l kay selville, etta tiedoksianto on tapahtunut, sekd sen muoto ja aika.
