TITLE I

COMMONPR OVISIONS

Article1

(ex Article1TEU) ( 1 By thisT reaty,theHIGHCONTRA CTINGP ARTIES establishamongthemselvesaEUROPEAN UNION, hereinaftercalled'the Union'on whichthe MemberStat esconf ercompetences toattainobjectives they havein common. This Treatymarks anewstage inthe processof creatinganevercloser unionamong thepeoples of Europe, inwhic hdecisionsaretake nas openlyas possibleandasclosely aspossible to thecitizen. The Unionshallbe founded onthe presentTreatyand onthe Treaty onthe Functioningofthe European Union(hereinafter referredto as'the Treaties'). Thosetwo Treaties shallhavethe sameleg al value. Article2

The Unionisf oundedon thevaluesofrespect for humandignity ,freedom, democracy, equality, the ruleof law andrespectfor humanr ights,including therightsof personsbelonging tominorities.These values arecommon to theMemberStates ina societyin whichpluralism,non-discrimination, tolerance,justice, solidarity andequalitybetweenw omenand menprevail.

Article3

(ex Article2TEU)

1. TheU nion'saimisto promote peace,its valuesand thewell-beingofits peoples.

2. TheU nionshalloffer itscitizens anareaoffreedom, security andjustice withoutint ernal

frontiers, inwhich thefree movement ofpersons isensuredinconjunction withappropr iate measures with respectto exter nalbordercontrols,asylum,immigrationand theprevention andcombating of crime.

3. TheU nionshallestablishan inter nalmarke t.It shallworkforthe sustainabledevelopmentof

Europe basedon balancedeconomic growth andpr icestability,a highlycom petitivesocialmarket economy,aimingat fullem ployment andsocial progress,andahighlevelof protection and improvementofthe qualityof theen vironment.It shallpromot escientif icandtec hnologicaladvance. It shallcombat socialex clusionand discrimination,andshall promote socialjusticeandprot ection, equality betweenw omenandmen,solidar itybetween generations andprotectionof ther ightsofthe child. It shallpromot eeconomic,socialand ter rit orial cohesion,andsolidarityamongMemberStates.

It shallrespect itsr ich culturalandlinguisticdiversity,and shallensure thatEurope's culturalher itageis

safeguardedand enhanced.

4. TheU nionshallestablishan economicand monetary unionwhose currency isthe euro.

5. Inits relationswith thewider world, theU nionshall upholdandpromote itsvalues and

interestsand contribut etotheprotectionof itscitizens. Itshall contributetopeace, security ,the sustainable developmentof theEar th,solidar ityandmutualrespect amongpeoples,freeand fair trade, eradication ofpo vertyandtheprotection ofhuman rights, inparticularthe rights ofthe child,aswell as tothestr ictobser vanceandthedevelopment ofinternational law ,including respectf orthe principlesof theU nited NationsCharter.

6. TheU nionshallpursueits objectivesb yappropr iatemeans commensuratewith the

competenceswhich areconferred uponit intheTreaties.

Article4

1. Inaccordance withAr ticle5, competencesnot conferred upontheUnioninthe Treaties remain

with theMember States.

2. TheU nionshallrespectthe equalityof MemberStat esbef orethe Treaties aswell astheir

national identities,inherent intheir fundamentalstr uctures,political andconstitutional, inclusiveof regional andlocal self-gover nment.Itshallrespecttheiressential State functions,including ensuring the territorialintegrityoftheStat e,maintaininglawandorder andsaf eguardingnational security.In particular,nationalsecur ityremains thesoleresponsibilityof each MemberStat e.

3. Pursuantto thepr incipleof sincerecooperation,theU nionand theMember States shall,in full

mutual respect,assist each otherincarr yingout tasks whichflowfrom theT reaties. The MemberStat esshalltakean yappropr iatemeasure, generalorpar ticular,toensure fulfilment ofthe obligationsar isingoutofthe Treaties orresulting fromthe actsoftheinstitutions ofthe Union. The MemberStat esshallfacilitat ethe achievementoftheUnion's tasks andrefrainfroman ymeasure which couldjeopardise theattainment ofthe Union's objectives.

Article5

(ex Article5TEC)

1. Thelimits ofU nioncom petencesarego vernedbythepr incipleof conferral.Theuseof Union

competencesisgo verned bytheprinciplesofsubsidiar ityand proportionality .

2. Underthepr incipleof conferral,the Union shallactonlywithinthelimits ofthe competences

conferreduponit bythe MemberStat esin theT reatiest oattaintheobjectives setout therein. Competencesnotconfe rred upontheUnioninthe Treaties remainwith theMemberStates.

3. Underthepr incipleof subsidiarity,in areaswhich donotfallwithinits exclusive compete nce,

the Unionshallact onlyif andin sof aras theobjectives ofthe proposedaction cannotbesufficiently achievedby theMember States, eitherat centrallevelorat regionaland locallevel, butcan rather, by reason ofthe scaleor effects ofthe proposedaction,bebett erachie vedat Union level. The institutionsof theU nionshall applytheprinciple ofsubsidiar ityas laiddo wnintheProt ocolon the applicationof thepr inciplesof subsidiarityandpropor tionality. NationalParliamentsensure compliancewith thepr incipleof subsidiarityinaccordance withthe proceduresetoutin thatProto col.

4. Underthepr incipleof proportionality,the content andformofU nionaction shallnotexceed

1. TheU nionrecognisesther ights,freedoms andpr inciplessetoutin theChar terof Fundamental

Rights ofthe EuropeanU nionof 7December2000,as adapted atStrasbourg, on12 December2007, which shallha vethesameleg alvalue asthe Treaties. The provisionsofthe Charte rshall notextendinany way thecom petencesofthe Union asdefinedin the Treaties. The rights,freedomsand principles inthe Chartershall beint erpret edinaccordancewiththeg eneral provisionsin TitleVII ofthe Chart ergo verning itsinterpretationandapplication andwithdueregard tothe explanationsref erred tointheCharte r,thatset outthe sourcesof thoseprovisions.

2. TheU nionshallaccedet othe EuropeanCon ventionforthe Protection ofHuman Rightsand

Fundamental Freedoms.Suc haccessionshallnot affect theU nion'scom petencesasdef inedin the

Treaties.

3. Fundamentalr ights,asguaranteed by theEuropeanConvention fortheProtec tionof Human

Rights andFundamental Freedomsand asthe yresult fromthe constitutionaltraditionscommont othe Member States,shallconstitut eg eneralprinciplesof theUnion'sla w.

Article7

(ex Article7TEU)

1. Ona reasonedproposal by onethird oftheMemberStat es,by theEuropean Parliament orb y

the EuropeanCommission, theCouncil, actingby ama jority off ourf ifthsofitsmembersaf ter obtaining theconsent ofthe EuropeanParli ament,ma ydet erminethatthere isaclearr iskofaserious breachb yaMemberStat eof thevalues referredto inAr ticle2. Before makingsuchadetermination, the Councilshall hearthe MemberStat ein questionand mayaddressrecommendations toit, actingin accordance withthe sameprocedure. The Councilshall regularlyver ifythat thegroundsonwhic hsuc ha deter minationwas madecontinue toapply .

2. TheEuropean Council,acting byunanimity ona proposalby onethird ofthe MemberStat esor

bythe Commissionand aft erobtaining theconsentoftheEuropeanParli ament,ma ydete rmine the existenceof aser iousand persistentbreach by aMemberState ofthevaluesref erredtoin Article 2, afterinviting theMemberState inquestion tosubmit itsobservations.

3. Wherea determination underparagraph2has beenmade, theCouncil, actingb ya qualified

majority,maydecide tosuspendcertain ofthe rights deriving fromtheapplicationof theT reatiesto the MemberStat einquestion,including thev otingr ightsof therepresentative ofthegover nmentof that MemberStat eintheCouncil. Indoing so,the Councilshall takeint oaccount thepossible consequences ofsuc hasuspensionon ther ightsand obligations ofnatural andlegalpersons.

4. TheCouncil, actingby aqualif iedma jority ,maydecide subsequentlytovaryorrevoke measures

takenunder paragraph3 inresponse to chang esin thesituationwhich ledtotheirbeingimposed.

5. Thev otingarrangements applyingtotheEuropeanParliament, theEuropean Counciland the

Council forthepur posesof thisArticleare laiddo wnin Article354of theT reatyon theFunctioning of theEuropean Union.

Article8

1. TheU nionshalldevelopa specialrelationship withneighbour ingcountr ies,aiming to establish

an areaof prosperity andgoodneighbourliness,f oundedon thevalues ofthe Unionandc haracter ised byclose andpeaceful relationsbased oncooperation.

2. Forthe purposes ofparagraph1,the Union may concludespecif icagreements withthe

countriesconcer ned.Theseagreementsma ycontain reciprocalr ightsandobligations aswell asthe possibility ofunder takingactivitiesjointly. Theirim plementationshallbethe subjectof periodic consultation.

TITLE II

PROVISIONSONDEMOCRA TICPRINCIPLES

Article9

In allits activities,the Union shallobser vetheprinciple ofthe equalityofitscitizens, whoshall receive

equal attentionfromits institutions,bodies, offices andag encies.Ever ynationalofa MemberStat e shall bea citizenof theU nion.Citizenship ofthe Unionshallbe additionalto nationalcitizenship and shall notreplace it.

Article10

1. Thefunctioning ofthe Union shallbe foundedonrepresentative democracy.

2. Citizensare directlyrepresent edat Unionlevelin theEuropean Parliament.

Member Statesarerepresent edin theEuropeanCouncilby theirHeads ofStat eor Gover nmentand in the Councilby theirgo vernments, themselvesdemocraticallyaccountableeitherto theirnational

Parliaments,or to theircitizens.

3. Everycitizenshall have ther ighttoparticipate inthe democraticlifeof theU nion.Decisions

shall betake nasopenlyand asclosely aspossible to thecitizen.

4. Politicalparties atEuropeanlevelcontr ibute to for mingEuropeanpoliticalawarenessand to

Article11

1. Theinstitutions shall,b yappropr iatemeans,give citizensandrepresentativeassociationsthe

opportunityt omakekno wnandpubliclyex changetheir viewsin allareas ofUnionaction.

2. Theinstitutions shallmaintain anopen, transparentand regulardialogue withrepresentative

associations andcivil society.

3. TheEuropean Commissionshall carr yout broadconsultationswithpartiesconcer nedin order

toensure thatthe Union's actionsare coherentandtransparent.

4. Notless thanone millioncitizens whoare nationalsof asignif icantnumber ofMember States

maytake theinitiative ofinvitin gthe EuropeanCommission, withintheframework ofits powers, to submit anyappropriat eproposalonmatterswhere citizensconsider thata legalactof theU nionis required forthepur poseof implementingtheT reaties. The proceduresand conditionsrequired for such acitizens'initiativeshall bedetermined inaccordance with thef irstparagraphofAr ticle24 ofthe Treatyonthe Functioningof theEuropean Union.

Article12

National Parliamentscontribute activelytothe goodfunctioning oftheUnion: (a) throughbeing infor medbytheinstitutionsofthe Union andha vingdraf tlegislative actsof the Unionf orwardedtotheminaccordance withthe Protocol onthe roleof nationalP arliamentsin the EuropeanU nion; (b) byseeingto itthat thepr incipleof subsidiarity isrespected inaccordancewiththe procedures providedf orintheProt ocolon theapplication oftheprinciples ofsubsidiar ityand proportionality; (c) bytakingpar t,within theframeworkof thearea offreedom, securityandjustice, inthe evaluation mechanismsf ortheimplementation ofthe Unionpoliciesin thatarea, inaccordance with Article70 ofthe Treaty onthe FunctioningoftheEuropean Union, andthrough beingin volved in the politicalmonit oringofEuropolandthe evaluationof Eurojust'sactivities inaccordance with

Articles88 and85 ofthat Treaty ;

(d) bytakingpar tin therevisionproceduresof theT reaties,in accordancewith Article 48of this

Treaty;

(e) bybeingnotif iedof applicationsforaccession tothe Union, inaccordancewithAr ticle49 ofthis

Treaty;

(f) bytakingpar tin theinter-parliamentar ycooperation betweennational Parliamentsandwiththe European Parliament,inaccordance withthe Protocol onthe roleof nationalParliamentsin the

European Union.

TITLE III

PROVISIONSONTHE INSTITUTIONS

Article13

1. TheU nionshallhave aninstitutional frameworkwhich shallaim to promoteitsvalues, advance

its objectives,ser veitsinterests, thoseof itscitizensandthose ofthe MemberStat es,and ensurethe consistency,effectiveness andcontinuityofits policiesand actions.

The Union'sinstitutionsshall be:

- the EuropeanParli ament, - the EuropeanCouncil, - the Council, - the EuropeanCommission (hereinafte rreferredtoas 'the Commission'), - the CourtofJustice ofthe EuropeanU nion, - the EuropeanCentral Bank, - the CourtofA uditors.

2. Eachinstitutionshall actwithin thelimits ofthe powers confer redon itin theT reaties,andin

conformitywiththe procedures,conditions andobjectives setout inthem. Theinstitutions shall practice mutualsincere cooperation.

3. Thepro visionsrelatingto theEuropean CentralBankandthe Court ofA uditors anddetailed

provisionson theother institutionsare setout inthe Treaty onthe Functioningof theEuropean

Union.

4. TheEuropean Parliament, theCouncilandthe Commissionshall beassist edb yan Economic

and SocialCommitt eeandaCommitt eeof theRegions actinginanadvisor ycapacity .

Article14

1. TheEuropean Parliament shall,jointlywiththe Council,ex erciselegislative andbudg etary

functions. Itshall exercise functionsofpoliticalcontrol andconsultation aslaid down inthe Treaties. It

shall electthe Presidentof theCommission.

2. TheEuropean Parliament shallbecomposed ofrepresentatives ofthe Union'scitizens.The y

shall notex ceedsevenhundredand fif tyin number, plusthePresident.Representationofcitizens shall be degressivelypropor tional,withaminimum thresholdof sixmembers perMember State. No MemberStat eshallbeallocat edmore thanninety-six seats. 3. Themembers ofthe EuropeanP arliamentshall beelecte dfora ter mof fiveyears bydirect

universal suffrageina freeand secretballot.

4. TheEuropean Parliament shallelectitsPresident andits officers fromamong itsmembers.

Article15

1. TheEuropean Councilshall provide theU nionwiththenecessar yim petusforits development

and shalldef inethegeneral politicaldirections andpriorities thereof.It shallnot exercise legislative

functions.

2. TheEuropean Councilshall consistof theHeads ofStat eor Gover nmentof theMember States,

togetherwithits Presidentand thePresident ofthe Commission.The HighRepresentative ofthe Union forForeign Affairs andSecurityP olicyshall takepartin itswork.

3. TheEuropean Councilshall meettwice every sixmonths, convened byitsPresident.When the

agendaso requires,the membersof theEuropean Councilma ydecide each to beassist edbyaminist er and, inthe caseof thePresident ofthe Commission,b ya memberof theCommission. Whenthe situation sorequires, thePresident shallcon venea specialmeeting oftheEuropeanCouncil.

4. ExceptwheretheT reatiespro videother wise,decisionsofthe EuropeanCouncilshallbe taken

byconsensus.

5. TheEuropean Councilshall electits President,by aqualif iedma jority ,f ora termof twoanda

half years,renewableonce. Inthe eventof animpe dimentor serious misconduct,the European Council canend thePresident's ter mof officeinaccordancewiththe sameprocedure.

6. ThePresident ofthe EuropeanCouncil:

(a) shallc hairitanddr ivef orward itswork; (b) shallensure thepreparation andcontinuity ofthe work ofthe EuropeanCouncil incooperation with thePresident ofthe Commission,and onthe basisof thew orkof theGeneral Affairs Council; (c) shallendea vourtofacilitate cohesionand consensuswithintheEuropeanCouncil; (d) shallpresent arepor tt otheEuropeanParli amentafter each ofthe meetingsofthe

European Council.
