Having called on interested parties to submit their comments pursuant to the above Articles ( 1 ), and having regard to those comments,Whereas:
1. PROCEEDINGS
(1) By letter of 11 February 2009, the Commission informed the Republic of Austria of its decision to initiate proceedings under Article 88(2) of the EC Treaty with regard to the sale of the Austrian State's shares in theAustrian Airlines Group.
(2) On 11 March 2009, Austria transmitted its comments on the opening of the proceedings to the Commission. (3) The Commission's decision to initiate proceedings was published in the Official Journal of the EuropeanUnion (
2 ). The Commission invited interested parties to submit their comments on the measures in question within one month of the date of publication. (4) The Commission received comments from interested parties. It transmitted the comments to Austria by elec tronic mail on 15 April 2009.
