2.It may be worthwhile :o examine the issue in the light of the letter written by

the Chief Information Commissioner on 14th September, 2007 to the Hon'b.e Minister of State, Shri Suresh Pachour (copy enclosed at Annexure

3.Understandably, a copy of the letter was sent to the Chief anister, NCT of

Delhi and the Chief Information Commissioner also had discussion with the HoMble Lt. Governor, Delhi. The response received from the P-incipal Secretary of Government of NCT of Delhi is also being sent iAnnexure 'C') 'or ease of decision-making.

4.It has been desired that it nay be conveyed that the Chief Information

Commissioner sometimes back have discussed the matter with the then Han'ble Miniser of State, M•nistry of Personnel, Public Grievances, and Pensions, Shri Suresn Pachouri along with the other aspects the desirability of having the IC from among present Defence personnel, not below the rack of Lt. General to be considered for appointment as Central Information Commissioner. This one addition to the existing strength of Information Commissioners will presumably strengthen the Commission enough to take care of the enhanced workload for :he time being. However, Chief Information Commissioner, Shri Wajahat Habibullah desires to discuss this point with MOS(Personnel: at the earliest. The Central Information Commission constituted uncer the Right to Information Act. 2005 consis:s of Chief Information Commissioner and four Central Information Commissioners Under the Act, the Central Government may increase the number of Central Information Commissioners upto ten, if deemed necessary.

2.The jurisdiction of the Central Information Commission extends to all

Ministries, Departments and Undertakings of the Central Government as well as to all the Union Territories including the NCT of Delhi.

3.As we discussed in our last meeting in your office chambers on 11 9.'07,

with the increase in awareness about the right to information, and increasing use of it by the citizenry, the workload of the Commission has increased manifold. It might be mentioned that at least 20% of the total number of appeals/complaints under the Right to Information Act received by us relate to the GNCT Delhi.

4.One of the reasons for this substantial share of Delhi is because of the

fact that the Delhi Right to Information Act was enacted in the year 2001 and is in operation since then. It is also a major element of Delhi's Bhagidari scheme promoting citizens' participation in governance. Delhi has a ublic Grievance Commission established under the State RTI Act, which consists of a Chairman and three other Members ncluding two part-time Memoers.

5.After the Central Act has come into force, the relevance of the State Law

as well as the workload of the Public Grievance Commission has considerably reduced. In fact there is some avoidable duplication of work. It also creates unnecessary confusion in the minds of citizens Some of the public authorities also find it difficult to deal with two Commissions dealing with he similar subject matter out under different legislations and with a different set o; procedural reouirements.

6.It is therefore suggested that it could be in the public interest, and a better

integrated implementation of the RTI Act in Delhi, if the Chairman of the Delhi Public Grievance Commission functioning under the Delhi Right to Informal on Act is appointed as a Central Informatior Commissioner to deal with appeals and complaints under the central Right to Information Act, 2005. This wi I enable the citizens of Delhi to seek access to irformatior on all matters concerning the Delhi Administration at one place. The location of the Public G-ievance Commiss on will be another facillating factor, in That informaticn can be accessed and grievance redress obtained under the same roof. This matter was discussed with Lt Governor Josh' who was of the view that this will also facilitate the public authorities of the State of Delhi

7.In the alternative. the Central GcAernment may kindly consider appointing

one more Central Infcrmation Commissioner to help expedite disposal at the levl of the Commission to who we may then assign disposal of matters relating to

GNCT. Delft.

Kindly recall your discussions with the Hon'ble Lt. Governor, Delhi regardirg recommendation or appointment of Chairman, Public Grievances COmTisS On, Delhi as Information Commissioner under Right to Information Act, 2005 for dealing exclusively with second appeals related to Delhi. The proposal has been exam ned and it has been observed that the Chairman, PGC is holding an office of profit and as such not eligible for appointment as Information Commissioner under Section 12(6) of R ght to Information Act, 2005. Moreover there are some other administrative and legal issues which do not qualify him fcr being appointed as Information

Commissioner.
