NOTE BY THE SECRETARIAT

Under Article 102 of the Charter of the United Nations every treaty and every international agreement en-

tered into by any Member of the United Nations after the coming into force of the Charter shall, as soon as possi-

ble, be registered with the Secretariat and published by it. Furthermore, no party to a treaty or international

agreement subject to registration which has not been registered may invoke that treaty or agreement before any

organ of the United Nations. The General Assembly, by resolution 97 (I), established regulations to give effect to

Article 102 of the Charter (see text of the regulations, vol. 859, p.,VIII).

The terms "treaty" and "international agreement" have not been defined either in the Charter or in the regu-

lations, and the Secretariat follows the principle that it acts in accordance with the position of the Member State

submitting an instrument for registration that so far as that party is concerned the instrument is a treaty or an in-

ternational agreement within the meaning of Article 102. Registration of an instrument submitted by a Member

State, therefore, does not imply a judgement by the Secretariat on the nature of the instrument, the status of a party

or any similar question. It is the understanding of the Secretariat that its action does not confer on the instrument

the status of a treaty or an international agreement if it does not already have that status and does not confer on a

party a status which it would not otherwise have.

Unless otherwise indicated, the translations of the original texts of treaties, etc., published in this Series have

been made by the Secretariat of the United Nations.

pas 6t6 ne pourra invoquer ledit trait& ou accord devant un organe des Nations Unies. Par sa resolution 97 (I), l'As-

r~glement, vol. 859, p. IX).

Le terme ( trait ) et l'expression < accord international nont 6t6 d~finis ni dans la Charte ni dans le r~gle-

ment, et le Secretariat a pris comme principe de s'en tenir A la position adopt~e A cet 6gard par I'Etat Membre qui

a pr~sent l'instrument A lenregistrement, A savoir que pour autant qu'il s'agit de cet Etat comme partie contrac-

tante rinstrument constitue un trait6 ou un accord international au sens de rArticle 102. I1 s'ensuit que lenregis-

trement d'un instrument pr~sent6 par un Etat Membre nimplique, de la part du Secretariat, aucun jugement sur la

nature de l'instrumnent, le statut d'une partie ou toute autre question similaire. Le Secretariat consid~re donc que

les actes qu'il pourrait &re amen6 A accomplir ne conferent pas A un instrument la qualit6 de < trait6 > ou d'( accord

international > si cet instrument n'a pas d~jA cette qualite, et qu'ils ne conf~rent pas A une partie un statut que, par

ailleurs, elle ne poss~derait pas.

hierna genoemd de Verdragsluitende Partijen,

ZICH baserend op :

DE BEZORGDHEID om de vriendschappelijke betrekkingen en de samenwerking tussen de twee Staten te bevorderen, en in het bijzonder, op de gemeenschappelijke wens om een nauwere politiesamenwerking tot stand te brengen ; DE WENS om deze samenwerking te versterken in het kader van de internationale overeenkomsten die onderschreven zijn door de twee Staten inzake het respect voor de fundamentele rechten en vrijheden, inzonderheid bet Verdrag tot bescherming van de Rechten van de Mens en de fundamentele vrijheden van 4 november 1950 alsook het

Verdrag nr. 108 van de Raad van Europa van 28 januari 1981 tot bescherming van personen ten opzichte van van de geautomatiseerde verwerking van persoonsgegevens; OVERWEGENDE dat de internationale georganiseerde criminaliteit een bedreiging vormt voor de sociaal-economische ontwikkeling van de Verdragsluitende Staten en dat de recente ontwikkelingen van de intemationale georganiseerde criminaliteit hun institutionele werking in gevaar brengen ; OVERWEGENDE dat de strijd tegen mensenhandel en de bestrijding van het illegaal verkeer van en naar het grondgebied van de Staten en van de illegale migratie, alsook de uitbanning van de georganiseerde netwerken die bij dergelijke illegale handelingen betrokken zijn, deel uitmaken van de bezorgdheden van de respectieve Regeringen en

Parlementen van de Verdragsluitende Staten ;

OVERWEGENDE dat de illegale productie en de sluikhandel in verdovende middelen en psychotrope stoffen een bedreiging vormen voor de gezondheid en de veiligheid van de burgers ; OVERWEGENDE dat het louter harmoniseren van de relevante wetgeving niet volstaat om het fenomeen van de illegale immigratie voldoende efficint te bestrijden; OVERWEGENDE dat het noodzakelijk is om een efficiente, intemationale politiesarnenwerking uit te bouwen op het vlak van de georganiseerde criminaliteit en de illegale immigratie, onder meer door middel van uitwisseling en verwerking van gegevens met het oog op de bestrijding van die criminele activiteiten ; OVERWEGENDE dat om dit te verwezenlijken een reeks maatregelen en een nauwe samenwerking tussen de Verdragsluitende Staten is vereist ;

HEBBEN BESLOTEN DIT VERDRAG TE SLUITEN

DEFINITIES

Artikel 1

In dit Verdrag wordt verstaan onder:

1. Intemationale mensenhandel, elk opzettelijk gedrag zoals hierna beschreven:

a) het betreden van het grondgebied van een Verdragsluitende Partij vereenvoudigen, de doorreis, het verblijf op of bet verlaten van bet grondgebied indien er gebruik wordt gemaakt van dwang, meer bepaald geweld of bedreiging, of wanneer er gebruik wordt gemaakt van bedrog, misbruik van gezag of andere vonnen van onder druk zetten van een persoon, in die mate dat de persoon geen andere retie of aanvaardbare keuze heeft dan zich te onderwerpen aan die druk ; b) uitbuiten op eender welke wijze van een persoon, wetende dat hij het grondgebied van een Verdragsluitende Partij is binnengekomen, er doorreist of er verblijft in omstandigheden die vermeld werden onder punt a).

2. Seksueel misbruik van kinderen

Elke vorm van seksueel misbruik of van seksueel geweld bedoeld in artikel 34 van het Verdrag van de Verenigde Naties inzake de Rechten van het Kind van 20 november 1989 met inbegrip van de productie, de verkoop, het verdelen of andere vormen van handel in pornografisch materiaal waarbij kinderen betrokken zijn, en het persoonlijk bezit van dit materiaal.

3. Technische ondersteuning

De bijstand die wordt verleend aan de politie- en immigratiediensten onder de vorm van logistieke steun.

4. Criminaliteit in verband met nucleair en radioactief materiaal

De inbreuken opgesomd in artikel 7 § 1 van het Verdrag inzake de fysieke bescherming van nucleair materiaal van 3 maart 1980.
