Constitutional law the voice

  • What is the Voice to parliament proposal?

The voice would provide advice to governments on matters relating to Aboriginal and Torres Strait Islander people, such as health, education and housing, in the hope that such advice will lead to better outcomes.
Under the constitution, the federal government already has the power to make laws for Indigenous people..

  • What is Voice Treaty and Truth?

This theme brings together key issues that Aboriginal people have been fighting for since colonisation began in 1788.
It also looks to spark important conversations about how as Aboriginal people we can have more say and control over our lives and how the continuing injustices of colonisation can be addressed..

  • What will the Voice mean?

The Voice, in its simplest form, would be an advisory body that provides advice to parliament and government on issues affecting Aboriginal and Torres Strait Islander peoples and communities..

  • Why do we need a voice in the Constitution?

Historically, Indigenous people have not been heard in decisions made about them.
There were even laws and policies denying them the vote.
A constitutionally guaranteed First Nations Voice will help ensure these past discriminatory policies are not repeated..

  • Why is the Voice important?

The Voice provides permanent representation and recognition for Aboriginal and Torres Strait Islander peoples in the Constitution..

  • A Voice to Parliament will be a constitutionally protected body to make representations to the Australian Parliament and the Executive Government on legislation and policy of significance to Aboriginal and Torres Strait Islander peoples.
The Voice will not have veto power over legislation and policy.
George Williams supports the Constitutional Amendment. He has written many articles in the Australian newspaper about the Voice which can be found here. Vote NO

Could a statutory voice be a constitutional voice?

A statutory Voice would have a relatively weak standing and legitimacy

It could not be expected to speak as loudly as a constitutional body

As such, Australians could come to the end of the pilot period without a clear idea of the impact that a constitutional Voice might have on laws and policies

What if a government had a legislative voice?

By contrast, a legislative Voice would be far more vulnerable

A future government could get rid of it by passing an ordinary law

To do that, it would only need to win the support of a majority of members in the House of Representatives and the Senate

What role does the voice play in Australia's Constitution?

Most recently, the government has released a set of principles that will guide the initial legislative design of the Voice, should a referendum be successful

The Voice also performs another important constitutional role: it recognises Aboriginal and Torres Strait Islander people as the First Peoples of Australia in the Constitution
