Criminal law legislation

  • 3 categories of law

    States and the federal government have laws making certain acts illegal, and each jurisdiction is responsible for setting punishments for committing those crimes.
    A state may punish a certain crime more harshly than the federal government (or vice versa), but a defendant can be charged and convicted under both systems..

In general, every crime involves three elements: first, the act or conduct (actus reus); second, the individual's mental state at the time of the act (mens rea);

What is a criminal act in New York?

Criminal act, or actus reus, is generally defined as an unlawful bodily movement (N.Y.
Penal Law, 2010).
The criminal statute, or case in jurisdictions that allow common-law crimes, describes the criminal act element.
One requirement of criminal act is that the defendant perform it voluntarily.
In other words, the defendant must control the act.
