Automated Child Support Enforcement System (ACSES) Proposed Legislation to Reinvest SomeFederal Child Support Incentives into ACSES Enhancements

Current Regulation: Section §26-13-112.5, C.R.S and Volume 6.809 requires one hundred percent of the federal incentives

received by the state to be passed through to the county departments. Incentives are earned based on program performance.

CDHS is proposing that the State may use additionalincentives (est. 14% of total incentives), earned due to a case

collections reporting change, to be reinvested into the ACSES.

Transparent and Collaborative Decision Making on Use of Funds: The IV-D Task Force would determine priorities for

ACSES and spending of this funding each year. The IV-D Task Force includes County Child Support Program Managers from

each region of the state, CDHS Leadership, Child Support Liaison to the Judicial Department, IV-D Attorney Group

Representative, and the Federal Office of Child Support Enforcement.

IVD-Task Force members would determine the project(s) that these funds would be used for each year. Any unspent funds

would be distributed to counties using the existing process. The proposed legislation will clarify that only new incentive

dollars that are expected to come into Colorado will be used and will not disrupt the $5 million in federal incentives that

counties currently receive annually

Focus on new projects that would improve the county user experience, increase efficiency, and benefit our customers.

This incentive money would not be used for large IT projects or significant system changes since that type of work would go

through as a Capitol IT request.

Need for Legislation Now: DCSS anticipates receiving the first award letter that reflects the reporting change in Spring 2023,

which is why legislation is required during the current session.
