Consumer law wrong price

  • What happens if the price is wrong?

Many retailers will offer customers the item at a lower price than it should be - either the incorrect marked price or higher but with a discount to acknowledge their mistake.
It is important to know that this is an act of goodwill on behalf of the seller and is not a legal obligation..

What happens if a price error is made?

When pricing errors are made and you have bought an incorrectly priced item, you are under no legal obligation to give the product back

There is only one situation in which the supplier can request additional money from you after purchase and this applies when there has been some discussion about the correct price of the item before you bought it

×Under the Fair Trading Act (FTA) and Australian Consumer Law, businesses are required to provide clear and accurate prices for products and services, and factual advertising. It is illegal for a business to mislead or deceive you about the things they sell. If incorrectly priced items mislead consumers, this is a serious offence. If a business offers was/now pricing, it must make sure it does not mislead consumers. When pricing errors are made and you have bought an incorrectly priced item, you are under no legal obligation to give the product back. If an item scans at a higher price than the displayed price, the business is required to refund the difference.
