NOTE BY THE SECRETARIAT

Under Article 102 of the Charter of the United Nations every treaty and every interna- tional agreement entered into by any Member of the United Nations after the coming into force of the Charter shall, as soon as possible, be registered with the Secretariat and published by it. Furthermore, no party to a treaty or international agreement subject to registration which has not been registered may invoke that treaty or agreement before any organ of the United Nations. The General Assembly by resolution 97 (I) established regulations to give effect to Article 102 of the Charter (see text of the regulations, Vol. 76, p. XVIII). The terms "treaty" and "international agreement" have not been defined either in the Charter or in the regulations, and the Secretariat follows the principle that it acts in accordance with the position of the Member State submitting an instrument for registration that so far as that party is concerned the instrument is a treaty or an international agreement within the meaning of Article 102. Registration of an instrument submitted by a Member State, therefore, does not imply a judgement by the Secretariat on the nature of the instrument, the status of a party or any similar question. It is the understanding of the Secretariat that its action does not confer on the instrument the status of a treaty or an international agreement if it does not already have that status and does not confer on a party a status which it would not otherwise have. Unless otherwise indicated, the translations of the original texts of treaties, etc., published n this Series have been made by the Secretariat of the United Nations.

INTERNATIONAL SUGAR AGREEMENT, 19681

CHAPTER I

OBJECTIVES

Article 1

OBJECTIVES

The objectives of this International Sugar Agreement (hereinafter referred to as the Agreement) take into account the recommendations contained in the Final Act of the first session of the United Nations Con- ference on Trade and Development (hereinafter referred to as UNCTAD) 2 and are : (a) To raise the level of international trade in sugar, particularly in order to increase the export earnings of developing exporting countries; (b) To maintain a stable price for sugar which will be reasonably remunerative to producers, but which will not encourage further expansion of production in developed countries; (c) To provide adequate supplies of sugar to meet the requirements of importing countries at fair and reasonable prices; (d) To increase sugar consumption and in particular to promote measures to encourage consumption in countries where consumption per caput is low;

CHAPITRE PREMIER

Les objectifs du present Accord international sur le sucre (ci-apr~s ddnomm6 al'Accord ))) tiennent compte des recommandations 6nonc~es dans l'Acte final de la premiere session de la Confdrence des Nations Unies sur le commerce et le ddveloppement (ci-apr~s d~nomme ((la CNUCED 2 et sont les suivants : a) tlever le niveau du commerce international du sucre, notamment en vue d'accroitre les recettes d'exportation des pays en voie de ddveloppement exportateurs; b) Maintenir pour le sucre un prix stable qui assure des revenus raison- nables aux producteurs mais n'encourage pas une expansion plus poussde de la production dans les pays ddvelopp6s; c) Assurer des approvisionnements en sucre ad6quats pour rdpondre, h des prix 6quitables et raisonnables, aux besoins des pays impor- tateurs; d) Accroitre la consommation de sucre et, en particulier, favoriser des mesures propres h encourager cette consommation dans les pays oii son niveau par habitant est bas; Le texte de l'Accord a dt6 dtabli par la Confdrence des Nations Unies sur le sucre de 1968 qui s'est tenue L Gen~ve du 17 avril au 1er juin 1968 et du 23 septembre au 24 octobre 1968. (e) To bring world production and consumption of sugar into closer balance; (f) To facilitate the co-ordination of sugar marketing policies and the organization of the market; (g) To provide for adequate participation in, and growing access to, the markets of the developed countries for sugar from the developing countries; (h) To observe closely developments in the use of any form of substitutes for sugar, including cyclamates and other artificial sweeteners; and (i) To further international co-operation in sugar questions.

CHAPTER II

DEFINITIONS

Article 2

DEFINITIONS

For the purposes of this Agreement :

(1) "Organization" means The International Sugar Organization established by Article 3; (2) "Council" means The International Sugar Council established by

Article 3;

(3) "Member" means a Contracting Party to the Agreement or a terri- tory or group of territories in respect of which a notification has been made under paragraph (3) of Article 66; (4) "developing Member" means any Member in Latin America, in Africa excepting South Africa, in Asia excepting Japan and in Oceania excepting Australia and New Zealand, and includes Greece, Portugal,

Spain, Turkey and Yugoslavia;

(5) "developed Member" means any Member other than a developing

Member;

(6) "exporting Member" means a Member which is a net exporter of sugar;

Article 2

Aux fins du prdsent Accord :

1. Le terme (( Organisation )) d6signe l'Organisation internationale du

sucre institude en vertu de l'article 3;

2. Le terme (( Conseil )) ddsigne le Conseil international du sucre institu6

en vertu de l'article 3;

3. Le terme (( Membre )) ddsigne une Partie contractante ou un territoire

ou groupe de territoires au sujet duquel a t6 faite la notification pr6vue au paragraphe 3 de l'article 66;

4. L'expression (( Membre en voie de ddveloppement )) vise tout Membre

d'Amdrique latine, d'Afrique h l'exception de l'Afrique du Sud, d'Asie h l'exception du Japon et d'Oc6anie h 1'exception de l'Australie et de la Nouvelle-ZWlande; elle vise aussi l'Espagne, la Grace, le Portugal, la Turquie et la Yougoslavie;

5. L'expression (( Membre ddveloppd )) vise tout Membre qui n'est pas

en voie de ddveloppement;

6. L'expression €( Membre exportateur )) ddsigne un Membre qui est

exportateur net de sucre;
